Looks to me as if under the federal act MB, not the consumer, must show two things: a material modification, misuse or abuse, and a causal connection, not merely the existence of the same; otherwise, the practice would be deceptive or unfair under almost all state CPA schemes.
I expect MB lawyers know these things.
Poof is right. Any lawyer stupid enough to advise MB to deny a claim simply on proof of modification, etc. is overlooking many issues, including the likelihood that such a disclaimer or limitation is void as violative of public policy. That lawyer will disappear....
