To Sue or not to Sue?

Hey gang,
I have a friend who is a pretty aggressive driver, and recently he got involved in an accident which threw him onto the hospital bed with a broken left arm, sprained neck, broken toe, severe bruising in the chest and facial region. He had initially thought that he was going too fast and hit an obscured pothole, and lost control.

But his insurance company and the San Mateo Police had concluded in their investigations and research that it was from a faulty rear rim. According to both reports from his insurance company and the police, the rivets of the driver's side rear rim came off completely causing the barrel to partially come off the rim center...SCARY ****!

His rims were made by iForged. And previously he had issues with the valve stems being defective, leaking and simply missing. He had questioned the quality from the get-go but now has paid dearly for not going with his gut feelings.

He wants to launch a lawsuit against iForge once he gets well enough to move around. Do you think he has a case? Even if he doesn't, I don't think I'll be getting any iForged rims, no matter how cheap they are or how similar they look to HREs.

The phonebook is full of attorneys who will tell him to sue. I would seek some counsel from a conservative attorney or practice and weigh the facts. If it were me and I wrecked my car do to a defect in the car or a part thereof, I would certainly consider it.

I am a consumer law attorney in San Diego and fellow C32 owner. It sounds very probable that your friend has a product defect action against Iforged, but definite answers are not possible without more details. I've heard nothing but bad things about this IForged company, from their service all the way down to their product. I'm sure this isn't the first time one of their products has been found defective and caused problems. A good lawyer should be able to find a history of complaints and bad products, along with the the police report and insurance company reports. Unless IForged could show that the product was abused or used beyond its intended use, I would think that your friend has a pretty good case. But I'm not a lawyer....just logical thinking on my part. I would certainly look into it.

Thanks for the insight Vomit, I've already relayed your contact info to him and now it's just a matter of when he recovers enough to be mobile and tend to such matters.

Didnt he hit a pot hole going to fast?How can you prove that the wheels caused this when he hit a ditch.

ANY wheel can rip apart its axcle after hitting a ditch and crashing.

And if he was having problems with the valve stems it seems the tires wernt mounted rite.

My reading of the original post was that he thought he hit a pothole but according to the investigation, he did not hit any pothole (or ditch). The wheel came apart and caused what felt like hitting a pothole and subsequent loss of control and crash.

He didn't hit anything, he told me he was just cruising at 95-110mph when he felt a sudden jolt and just lost control of the car. He had showed me a bunch of the pictures (Pictures I believe the police took and handed these to the insurance company and my friend, I didn't really ask where exactly they were from) and there were 9-12 evidence shots(I cannot remember exactly how many) that showed the rivets + faulty ends etc lying on the road and several shots of the rear rim barrel+center completely mangled and ripped apart, as well as shots of what looked like deep gashes from the INNER tire.

No potholes or other obstacles were found in the vicinity of the accident. I will try to get him to share more when he gets better and is able to get on a computer.

I would suggest not talking about this any further on a Forum. It will only hurt his case!

This accident is exactly what I have been trying to avoid!! I have HRE 547R's on my SL55 and they are a 3 piece wheel. Last summer I chipped a little bit of the clearcoat off of the lip on one of the rear wheels. Long story short when I took the wheels off my car for winter storage, I sent my wheel out to be repaired. (this was in November) The owner of the company told me my wheel was being sent to HRE for the repair when in fact he was trying to fix it himself. The repair was taking soooo long because one of his repair guys had broken the screws while taking my wheel apart and they were trying to figure out how to fix it. I told the owner of the company that once they had taken my wheel apart and broken the screws, I felt the integrity of my wheel had been compromised. So after many heated arguements with this guy I finally decided to get my lawyer involved. The guy that damaged my wheel is buying me a brand new wheel from HRE THANK GOD!! Best of luck with your friend. Let us know what happens!
