My cars been at the dealer since Friday and I had the warranty since Feb. 8th of 07. Now I purchased it from autobrokerswarrenty.com and they did all the contract work and when I purchased it the broker who sold me the policy put down 33,001 miles instead of 35,500. so now my car is in for service and I put it in for front seat control modules battery drain they got approved on Fri., heated seat not working denied because they state it is an upholstery item, o2 sensors inactive bank 1 and bank 2 denied, all those are covered under the platinum plan. Now today I get a call from my mb dealer telling me they denied my all my claims and there not paying for nothing. I get on the phone and they mercury tells me there is mileage discrepancy and they will not pay for anything because they pulled a car fax and it states the car should have 35,000 since Jan’s inspection, the broker entered 33,001 instead of 35,500 never correcting the mileage after I brought it to his attention when I got my contract in the mail, and on the car now there is 36,345 so I am under the 1000 miles and they wont make any exceptions.

Sue them. The warrenty people. They are liable for the mileage issue. I there anything showing the mileage being less then 35,500 after the warenty was added to show he put it in wrong. Oil change service record, anything. If you can prove he put it in wrong, then you have some kind of a case and that company will have to do something about it. If you live near Tampa FL ill give you the name of my lawyer, if she cant help you, im sure she knows someone.
Technically thats fraud. Knowling entering in false information on a contract. It voids the contract. In wich case, if you can proof it was fake, you can go after damages. Wich would be the car not getting fixed. And also you can sue for being without your car for the time it takes to get things resolved.
I would talk to a lawyer about it.

You bought the warranty at 35,500 but the broker put 33,000. I assume the warranty at least covers the next 40K miles on the top of 33,000.
You now have 36K... why was your warranty denied?
It would make sense if you bought the warranty at 33,000, the broker put 36,000 and you're at 35,000 now... since the warranty covers mileage above 36,000.

3/06 has recorded 32,731 mb records, my car if u pull it up on car fax says it had 35,850 as of 11/06 inspection and on 3/07 car was in for cataylic converter replace with recorded milage of 35,973 with mb records.
i never drive this car because i have 2 car and because of the winter months in ny makes no sense cant go anywere.
so they denied my claim because the contract showed 33,001 and the car fax they pulled up after 5 days the approved claim on fri to tell me there is milage discrepincy

He got denied because his warranty didn't cover things that happened less than 1000 miles after the warranty kicked in. The warranty people are right. You should have waited longer before taking it in. Sorry.
but its to the point there error for approving the claim and i even have a approval # that was given to my dealer. why would they approve it and then denie it after. i would have pulled my car and never gotten anything fixed if they told me my warrenty still wasnt in effect from the first day.

Ahhh... make sense.... sorry for my ignorance... never bought an extended warranty

They approved it based off of the false information that was put on the paperwork. Once they investigated, they found the error and denied the claim. There is nothing for you to fix. They are right. If the correct mileage was entered on the paperwork, the claim would have been denied from the beginning.Originally Posted by mbfan03

I mean there's a shot in hell that they might approve it if you put up a fight, but I doubt it, they are clearly in the right.

But you're missing the point -- with the corrected mileage this repair is not eligible for their warranty coverage. It doesn't cover things that happen within 1000 miles of the policy kicking in. You should have put on some more miles before taking it in for service.Originally Posted by mbfan03
i did call and tell them to change the contract milage when i finally recieved my formal contract and they never did i guess. ohh yeah and i am definetly putting up a fight till the very end
You're actual mileage when you got the policy was 35,500 and you took it in for service at 36,345. That's 845 miles, which is less than 1000. Claim denied. It's open and shut.

Right, because they caught a mistake. Fake information was entered on the application. They CAUGHT it. It's like being preapproved for a loan where the application said you made 200k a year, then they later find out that you make less and deny the loan when it comes down to actually give out the funds.Originally Posted by mbfan03
ok i understand that but my point here is that they approved it and then deniend the claim 5 days later they should have told me the policy wasnt affective on Fri instead of approving the claim.
There is no one to sue and no one screwed you. You simply took the car in too soon which is your own fault. I'm sorry, it really sucks. You're lucky that they didn't cancel your policy.

And then if/when you bring it in later to have the repairs done (after the 1000 miles) they will then deny your claim based on PED - preexisting damage. Originally Posted by jgsx

I had the same problem with my old warranty company. Had the warranty straight through the dealership I purchased the car from and they somehow jacked up the mileage on the warranty paperwork saying I had MORE miles on the car than I actually did. Put over 5k miles on the car, filed a small claim and everything was approved till the very end. They pull carfax and somehow figure I have/had LESS miles on the car than initially reported and denied it based on mileage discrepancy. Spent a week getting that straightened out and they decided to honor my warranty. Later they come back and say it is a preexisting problem and denied it based on that. Fought THAT issue and they finally end it with, "we no longer cover AMG automobiles as of" such and so a date. They gave me a full refund and sent me on my way.
That is when I ended up with Mercury and have been VERY pleased with them.mbfan03, did you get my PM with my claim number and all other info? Why would they cover all of my parts and not yours? I am assuming simply because you do not have the platinum coverage? I learned the hard way in the past, always buy the best warranty you can.
Best of luck to you in getting this straightened out. I know first hand how frustrating it is!

Yup, it's very unfortunate. Basically those repairs are going to be paid out of pocket. Too bad the car can't be Starmarked.Originally Posted by SilverBulletAMG

Who's your warranty agent? It isn't Dave is it?
Anyways, if you have an actual Mercury plan, I'm not sure your claim would even get paid if you had passed your underwriting period. Those contracts are full of red tape and chalk.

That's a lot of red tape and I wouldn't have any piece of mind knowing those restrictions are in my contract.

ok the end result of today was good news i guess I spoke to a supervisor at mercury andhe was able to pay half the claim it was 701.00 so i had to pay the reamining 350.50 not so bad better than paying all of the 701.00 and they didnt drop me either. so everything it fixed and the policy continues as normal.

You guys kept me on the edge of my seat here. I have Mercury platinum for more than a year now and I'm about to make a claim in the next 3 months. Hope everything turns out well.

The fact that you had to pay $310 is pretty bad actually. You're not supposed to pay anything but your co-pay with your warranty. Had you gone with a better plan and paid a little bit more, you wouldn't have had to deal with this.
Good luck in the future. This was only claim #1. There will be more to come.
My advice: Cancel and get a pro-rated refund.

If you have an MB, either a Fidelity Platinum or a Great American Full Coverage. CNA writes a pretty good contract as well. Stay away from Brokers, RRGs, and companies that self-administrate.Originally Posted by mbfan03
