Last week my car died on the way to the gym with an ESP warning on the dash. I restarted the car and it ran fine till yesterday afternoon. I am leaving the marina and the car dies 3 times in a row and then at every stoplight it is reving up and down and lurching forward. I finally make it home and now it won't even stay running. Constant ESP failure on the dash and it immediately dies. WTF, this car has 14K miles on it and I shuffled through the glovebox and found it has been in for service 16 times for all kinds of stupid **** from sunroof not closing to check engine lights to no brake lights. Do I have a lemon or is this something I should expect from Chrysler, er I mean Mercedes Benz? Also has anyone experienced these ESP malfunctions and what is generally the cure?

There have been service bulletins on the ESP issue due too bad grounding. These bulletins are a year or two old by now and I would think they would have been done to yours with all those trips to the dealer.
You dont look at service records when you buy a used car? you had it coming bro, every car manufacturer has problems and specialy buying a used car you should have been more weery.

As Mr Zeppelin indicated, there are bulletings regarding the wiring of ESP... dealers should be able to fix that...

Seems that you were NOT aware of the car's problems BEFORE you purcahsed it...otherwise you should've known (that you had a piece or crap car... an expensive piece of crap I might add ).. but now the "damage" aka Purchase has been done and the car is in your hands... or more it seems in hands of the lord at this time

Lemmon laws vary from state to state, but the normal rule is that, you as an owner, must have a minimum of 3 well documented instances where you brought the car to the dealership with the same problem and the "problem" in question was not fixed in 3 tries. This has to occur in within 18 months of 18 thousand miles (California) from the time of purchase. If you, as an owner, have such documentation on hand (not counting previous owners problems, as they don't count, again, depending from state to state, as some "may" allow you to use prior records) then you may qualify for a lemon case. If that is your case, then you will be entitled (all depending on the current state laws) to a full refund of your purchase price + any applicable taxes... anything you spent on your car???, like any mods, TLC, etc???... whelp??? that you don't get compensated for... HOWEVER... oh yeah.. there is always a however... I am not a professional law maker... but if you want to start your process to get your money back and/or see what your options are... best is to get a professional to handle your case... if you qualify... no matter what the dealer does, you will win... is just a matter of time and that the case is worked through the paperwork process ... (which can be months, or years )

but seriously, get it checked out. If you do buy a used car in the future, absolutely make sure to check out it's service records to see what has been repaired and such.
