I had the problem and dealer changed the gas paddle two times and still have the problem and I have mhp v3 tune and dealer will change the control unit .

I'm not particularly worried about them flashing the car back to stock since power chip is literally 8 miles from my office I could just have them flash it back. I'm worried that the dealer will find out that I flashed the ECU and they might decide to void my warranty. I guess I will call Power Chip in the morning to find out my options.

I think you have it backward. They can void your warranty for any reason if they want to and you have no ability to stop them. It'll be up to you to file a lawsuit and prove they shouldn't have done it.

What "control unit" will the dealer change? Do you mean reflash the MHP ECU map back to stock map? Can you explain in more detail? Thanks!

they changed gas paddle two times and checked all sensors and now they blame it on MHP Tune So they say you need to change Control unit i think New ECU it cost 2500$ so any ideas before i talk to dealer agin dealer ?

I think MB refers to the ECU as the ECM. I think they're referring to the throttle control module - they replaced that on mine when I was having this problem.

Still surprised each time I see a thread about possible ECU problems from people with flashed/modded ECU's, with suggestions to defraud MBZ in attempts to not get busted about your mods.
It's a simple equation: you modify the car, warranty can (and usually WILL) be gone. People on shoestring budgets who can barely afford a C63 in the first place and can't afford the risk--don't modify your car. Duhhh?
No proof needed on the dealer's side other than a modification, and the burden of proof is on the owner to show the mod didn't cause the problem.
Anyway, glad the OP's problem was resolved. The shutdown sounds scary.

could not agree with you more! I bought an 09 dodge ram and it has a lifetime warranty bumper to bumper from dodge (i know it sounds crazy but they offered it to sell the new Ram). anyhow lots of people mod the truck and think that dodge is going to honor said warranty. If any of us were those in charge at the manufacturer we would be voiding warranties all day as i assume most people with enough money to buy a benz have some degree of business acumen. Anyhow argue what you will but once you mod accept that most likely your warranty is done and there is no invisible ecu change...

I know this thread is old, but it seemed worthwhile to revive it. This happened to me today. First time in my ownership of 5k miles (car has 23k on it now).
Was in sport mode, as I am 90% of the time. 50% throttle away from a light. Around the 2-3 shift, I got the ESC message and no throttle response. Pulled over (very lucky I was on a quiet two lane road with shoulders) and sat there a second waiting for something to happen. I did notice the idle seemed a little jumpy, which is something I haven't read in other posts. Finally, I figured I'd shut it off and restart it. Everything seemed fine after that. Drove it hard for a few more miles and no issues. Very disconcerting.
Related to this, is there a way to shut off the car and restart it while it's moving, with the keyless package? I got to thinking that I might need to do this if this crap happens again and I'm on a highway or something, vs. coming to a complete stop. I tried it in a parking lot, and when I'm rolling forward, the car would not shut down no matter how long I held the button down. I tried it in gear and in neutral.

It's happened to me once before. Oddly enough, it happened again last night. I couldn't accelerate. I pulled over, restarted the car and it was gone. I was originally told it was a glitch. Gonna have it checked out again.

Interesting. I had an 03 ML500 that would go into "limp mode" it was an issue with the accelerator pedal as well if I remember correctly. It took several trips to the dealer before fixed. Scary when you are at normal street driving speeds, I can't imagine highway speeds!

Both times this happened to me, I was driving at low speed. The first time...maybe a year ago, happened as I was cruising through a local intersection, nothing too busy. The dash lit up and I pulled over, restarted the car, and everything was fine.
Just this week, I probably drove 100 miles already and washed my car and was joining up with a couple of other German cars for a photoshoot. While cruising at about 35mph, this happened again and I had zero throttle response. I pulled into a parking lot, restarted the car, and it was fine.
I'll probably have my usual SA check it out today or tomorrow, but I don't have an idea of what the cause could be. I wasn't in M or messing with ESP at all in either occasion. I've also had this Velos tune for almost 3 months with over 3k miles on it, so I doubt it's related to the tune.

My 2003 ML500 did the exact same thing as everyone is describing on here. Die, pull over, restart and go. It finally went away after the dealer fixed throttle control - accelerator. Sorry I don't know the correct terminology for it. That was several years ago. There has to be a MB tech here that knows what causes this. I will ask my service rep if he recalls. They did try and flash the ecu a few times prior to no avail. Of course no tune on that old ML500 to worry about!
