Exclamation HVAC Class Action Lawsuit

Anyone get a notice about this class action lawsuit in regards to the HVAC system emitting foul odor and/or mildewy odor...etc? I got a postcard but the website it points to is https://www.mercedeshvacsettlement.com/

I received that as well. I did notice a funky outdoor come out of the A/C system recently, although I haven't driven the car in a while with the whole COVID-19 situation. When I go get it checked out I'll keep this in mind.

Yes, got it, too. If you haven't had the issue and/or not paid for a repair out of your pocket, you can just ignore it, unless you wanna opt out of the class and reserve your right to sue directly. All cars will be covered fully (during warranty) or partially for up to 10 years if the issue occurs in the future. If you have or had the issue and paid for a cleaning in the past or are going to pay one between now and December, you'll have to file a claim. But for cleanings after December, it will be handled by the dealerships directly.

Thanks for explaining that. That was actually my concern. Like right now I don't see this issue but want to know if dealer will fix it if it comes up later even if its past my warranty period.

A mildew/mold foul order is a common occurance in many cars especially in warm humid climates when using your A/C. It's easy to eliminate. Use a disinfectant such as a Lysol spray and spay it into the cabin air intake. Our W205 intake is located under the hood (right rear at the firewall) with an easy to remove filter covering it. Turn on the A/C with fan speed on high and spray. Doesn't take a lot of disinfectant to eliminate the odor. Car parts stores have this disinfectant but at a much higher price. A class action lawsuit because of this...what lawyers won't try to do! Hold on, just wait a bit longer, the lawyers are going to try filing lawsuits because of the Corona Virus. I've already seen indications of this in my city - New Orleans, the personal injury lawsuit center of the country.

Yeah, mine came with the cabin fragrance thing and I have topped it a few times in the last year or so. Works well and dont have an issue. Now, my wife's Range Rover, that stinks at the moment.

Generally yes I would agree with you on the easy fix however in this case it seems they're stating there is a "defective design" in certain models up to 2019. This implies to me its not just the filter which you can replace and all be fine. It seems to indicate something along the ducting that can collect mold..etc. Of course I am speculating here but that is what it sounds like to me in this case.

I have had 4 of the listed vehicles. All of them have had the problem to one degree or another. The convertible is the only one that’s not gotten rancid, yet. It’s not an environment issue but a design issue. Mercedes changed the orientation of the coil under the cash resulting in water accumulation on the grids. Those grids serve as great hosts for the slime that made the cars rancid whenever the air came on. Many stores and probably corporate balked at paying for the cleaning process themselves and cleaning only did so much since the design itself is the problem. Some of them wanted stupid money to ‘fix’ the smell. The next step Mercedes took was to Do a software update to have the fans continue to run after shutoff trying to dry the coil surface of residual water. That was somewhat effective in my last GLE.

And contrary to one comment, while the lawyers are making money they didn’t create the problem and Mercedes could / should have stepped up, like my local dealer did, and taken care of the problem for their customers. Instead some unscrupulous dealers made a ton of money on cleanings and “repairs” that ultimately had to be redone. Fortunately the lawyers forced Mercedes, despite their disclaimer to not admitting liability, to do the right thing. I don’t have any problem with them getting paid for providing that service.

Interestingly, my (terrible) dealership just emailed me a SPECIAL OFFER to clean the HVAC system and replace the cabin air filter for ONLY $225. The timing is impeccable given the HVAC class action mailings.
