CLK swallowed by Truck... :(

Angry CLK swallowed by Truck... :(

ok... so, going home after a somewhat long day of work... at about 25-30 on the 10-E.... all of a sudden, a white Tacoma decides to cut me off, and jams on his brakes...

After which, I jam on my brakes... but, to no avail... our cars kiss...

I'm about ready to but i stay composed... i call the cops, and CHP arrives in about 5 minutes...

At this point, my car is underneath his truck... with his rear axle all up on my hood, somewhere over my driver side fender...

To make matters worse, after I had the car towed (regular tow truck with dolly system) to a local shop to leave overnight, a second tow truck (flat bed) was used to carry the car over to my preferred body shop (i did not accompany the tow truck driver)... When I went to look at my car today, the damn tow truck must have tore up my bumper either going up or down the ramp... Rip the bumper in half and tore it off on both sides...

To make matters worse, since I rear-ended him, CA law states that I'm at fault... and unfortunately, thats how my adjustor wants to handle the case... therefore, my premiums will now go up... AGAIN!

Now, its a waiting game to see how long its gonna take for the car to get fixed... sigh

Holy ****tt. My heart really goes out to you, having done up the car nicely, then having it ripped apart like that.

Hope it doesn't cost a bomb to fix.

dayam danny ...sorry to see that happen...saw your car at the meguires meet and it was really clean....sad to see it like this now...which body shop did u decide to go with?

My car is at Marina Auto Body in Marina del Rey/Los Angeles... They are a MBUSA authorized/certified repair center, as well as one of very few CL-Class certified repair centers...

Hopefully, I will get my car back in a few weeks... first estimate is about $10,000 in repairs, about 3-4wks turnaround... will find out more details by Monday...

geeez man, my condolances, at least you were ok tho. I'd be pissed if that happened to my car, but i've had wrecks before and the car always ends up fixed sooner or later. Best of luck on the repairs.

Bro, I feel for you right now man. Living in LA is a ***** with all these dumbass drivers around. I've got hit three times already (none ever major thank God) by other people. The rain hasn't helped since its like driving on ice for these socal natives. It really sounds like the other driver was at fault switching lanes w/o enough clearance. Had a police report not already been on file, I think you could put some pressure on this other guy to admit fault and not get screwed like this. I've threatened to f*** up a driver in the past and most people will concede at which time you can make a cell call to your insurance company and get them to admit fault for the accident on the scene. Emotions always run high in those times and thats when people are most vulnerable and easiest to exploit. Be sure to explain to your insurance company the circumstances and they might at least grant you only partially at fault, saving you from rough preiums.

it would have been better if you had speed up and not let him by. If he crashed your car on the side, on your lane, the law would have been on your side.

I'm really sorry to hear that man. Hope everything turns out fine and you could get your car back in shape soon.

Anyways, so, let's say if you have a rear bumper that you need to repaint. One day you are on the road and you cut someone with just enough gap for you to squeeze in, and suddenly you brake hard enough just for the car behind you to hit your car. Then, whose fault is it?
I just don't think the laws that say that the one who rear-end is always at fault is just not fair to me.

ultimately, i'd like to avoid all accidents if possible... but, very true... if i'm gonna get hit from someone cutting me off, i'd let them hit me on the side...

haha... my rear bumper could use a little bit of repainting... but, i really don't want my car in the shop more than it needs to be...

i got my fingers crossed to get my car back before my bday... but, i don't think thats gonna happen...

STUPID TRUCK DRIVERS!!! Good to hear you are in good health, and the car does not look too bad. It looks liek the engine was untouched, hopes it all works out, good luck (looks like a brembo 15" brake kit is in your near future? )

That has got to be pure . What about witnesses? How can you be at fault in this situation?

it wasn't raining the day of the accident... and there were no witnesses. so, for now, i'll have to see how much the adjustor wants to pursue the case.... they may sing a different tune once they find out how much my repairs are...

15" brembos... hmmm well, while that sounds nice, i don't think any brake system wouldn't allowed me to stop in time... but, its worth considering

Heres a good way to look at it. If you would have paid out of your pocket directly for the repairs, you would have spent more later for anything that might go wrong as a result. At least with insurance you know the adjuster and the bodyship are going to go above and beyond what actually needs to be replaced, and as a result you will be less inclined towards problems in the future.

A little far fetched but a better way to look at things.

if the insurance company is being generous about the replacements... then, i'd opt for the Expression CL style hood, get new xenon headlights... and fresh paint on my rock-chipped hood & bumper... thats the brighter side of it..

the worse thing that could happen... is the insurance company decides to give me back all stock *****z...
