if true, it is really very very disappointing... do you have more details about the nature of the failure?
also, the triggering factor should be more related to the mileage, not the time (unless we are talking about seals failure or something similar)

so its not mileage based at all and totally time based. Something to do with a seal in the transmission that holds the bearings in place which gets harder and shrinks after 8-10 years and once it shrinks, thats when you start seeing the leaks. So yeah not a mechanical failure per say but still something that would likely require a replacement due to the cost.

even the hollywood mechanic guy says that for mercedes, its better to just go to the dealer for a replacement as opposed to him repairing it coz his cost wouldnt be much less. He says only in case of ferraris its more practical to get it fixed by him because ferrari charges much more than mercedes for a replacement. Around 15k for mercedes vs 40k for ferrari.

Can the seal be improved using something aftermarket?
