Release of Claims

Just had my AEM done last week (2015 GL350) and started looking at the claims process. Has anyone noticed what a crock the "Individual Release Of Claims" is? Notice that Section 3 states "I expressly understand and acknowledge that the Settlement Administrator will make the final and unreviewable decisions regarding the Class Member Payment....and this Individual Release remains effective and binding even if I disagree with the amount of my Class Member Payment..." AND Section 5 which overrides Section 1542 of the California Civil Code that " A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of the executing the release..." - i.e. if something comes up in the future - well too bad for you. And section 6 states this even more unequivocally! Wow.

But it is too late to object - the deadline for objection was 5/24/2021

I never read that crap and just assume there is something in there I won’t like because am I really going to fight it? No. It’s not worth my limited time before I shuffle off this mortal coil.

My AEM has been flawless. Both cars done. Very happy with the warranty as well.

Now I would just like the checks for closure.

Anyone with knowledge of the forthcoming checks please update us.

Glad to hear you have been able to get your vehicles repaired with the new AEM, unfortunately having a 2012 GL350 I won’t see a fix anytime soon. I was advised the AEM for my vehicle would be available during the 3rd quarter of 2021 but now it’s been changed to being available the 4th quarter.
Regarding checks, I would assume it will be at the conclusion of installing AEM’s in vehicles registered in the lawsuit so maybe well into 2022 or 2023.

Don't ask me, I have 3 of AEM already performed and 4th on the way, what suppose to make me a rich person (still cry comparing to Bil) but knowing how US litigations go, I'll be happy receiving checks before mid-year of 2022.

I own a 2014 GL 350 Bluetec and except for the emissions problems has been pretty maintenance free. I qualified for the Emissions Settlement related to all the diesel issues and got the required NOX sensors replaced etc done under this settlement in June. This extended the warranty an additional 48k. So 2 months later car goes into limp mode. I get it diagnosed locally (3 hours from MB in Missoula) and its the EGR that needs to be replaced which is under the extended warranty. Called DeMarios in Missoula and they are backed up 2 months in the service department. So I just went ahead and paid the $1k+ bill. Local mechanic says contact MBUSA directly with claim and maybe they pay it.
So any idea who/what/where to contact in the mothership MBUSA for my best shot?

Update: MBUSA says go through dealer to process claim. Called dealer, they confirmed process with area warranty rep and I am sending paperwork to service manager for forwarding on MBUSA.

Still haven't got the check. I just want to report after accumulating 6000 miles since AEM that my E250 MPG went from 29.8 mpg to 28.3 mpg driving on various roads. (I live about 2000 ft above sea level and commute to about 500 ft sea level - so typical MPG takes a beat down from the government published numbers by about 10 to 15%) this is a solid 5% hit to the mpg since the AEM. Initially, I also found the torque lag to be minimized when the AEM was initially done (perhaps due to new DPF) but that has moderated a bit. Still, the power is actually better than pre-AEM.

I agree with your impressions. In particular I find increased fuel consumption when the engine is cold and warming up. The reduction when warm seems less.

I do think the car drives better overall. The transmission was obviously reprogrammed and very much for the better.

Side note: I just read the specs for your E250 and had no idea that splitview was available on the E class. That's very cool!

Had the AEM mod accomplished on my 14 E250 last May. I do a lot of highway driving and after about 6000 miles fuel mileage is the same as pre-mod, 45.2 mpg. CEL came on a couple weeks ago so I had the Raleigh NC dealer (Lieth) check it out and found the boost pressure hose split. Covered under the extended warranty.

Had the AEM mod completed in March on my 2015 GL350. Filled the claim almost two months ago. Called the settlement phone number last month. Was told no information is available on the timing of the checks.

Here is what the dealer attached to the hood at AEM Mod service:

I find the label interesting that it is just completed with a Sharpie and doesn't include the vehicle VIN. Also, the placement on the hood is odd as the hood could be replaced. I'm surprised it isn't placed on the body

It is not a statutory / mandated mod... therefore it is not something that authorities may need to refer to for the life of the vehicle (such as the vehicle VIN) and thus does not have to be permanent. It is akin to a sticker that says that a vehicle's A/C system has been converted to run R134a refrigerant from R12... it is simply to alert mechanics and/or future owners of the car that the modification has been performed.

SO the area warranty rep says the I now need to go through the MBUSA Bluetech Settlement entity which doesn't make sense since its clearly MBUSA extended warranty work. Reached out to that entity awaiting reply.
Meanwhile the dreaded check engine light popped back on and now the EGR temp sensor was showing faulty. Replaced that and 2 weeks later check engine light is back on. Same code. Been driving it and it faulted 3 more times. Hope it doesnt go into limp mode.
Kind of wishing I just left things alone at this point since the new NOX sensors etc seem to have brought a new set of problems.
