When people use my pictures without permission (especially to make money) I always call them on it or report it to Ebay.

lots of cars
If they want a picture, they can sponsor someone for it. That's how it works with all places. If they are going to steal your pictures after all the hard work and money you spent, just ask them to take them down.

Doesn't bother me...

A bunch of EBAY vendors used pix of my C6 Vette because of it's body mods...

i just don't get it....i may be new to this forum but have lurked for a year or two and have had various benz's for over twenty years [altogether about 70 cars by now]. as far as i can tell, the pictures in question were in the public domain, not copyrighted and all originally posted by the owner for the enjoyment of anyone who wants to look at them. the ebay seller posted the pictures in connection w/ his auction [a fellow w124 owner btw] as an example of the style of spoiler and how it looked installed. he never represented that any were his car or that he was selling the exact spoiler pictured on the car. why the excessive indignation? IMHO if you don't want pics of your car used on the net, either don't post them, or copyright the image. there is no right of privacy involved or anyone 'making money' off of your image, so lighten up...

Since RBYCC is not complaining, this topic is moot, but the ebay seller is certainly making money using his image. Agree with most of your post.

I actually exchanged a few emails w/ the guy over the usual moronic internet behavior and FWIW he isn't a drop shipper...he owns a bunch of w124's including a 500e and seems to be a regular guy. the 70 cars is over about 30 years, benz's for 20 of those years. I went though a serious vintage Porsche jag back when they were affordable and before I had kids...bought and sold [even restored a few] '55, and two '56 speedsters, '57 A coupe, '64 SC coupe w/ a manual sunroof [one of about 5!], '79 930, '81 SC Coupe, and '83 SC Cabrio...ahhh those were the days. Now the Kombi is far more practical.

If he's not a drop shipper, how come not just take pictures of the spoiler?

Wouldn't that be more helpful for the buyer and the seller to avoid any misrepresentations?

Sorry, I'm feeling a little bit illogical today . Maybe, somewhat irrational to expect actual pictures of the product.

I believe in California it is illegal to have someone use your pictures without permission.

I lost the California Civil Code for it though.

I agree with YNVD. It wouldn't bother me if somebody used a picture of my car for something, even to make money. What bothers me is that he is essentially misrepresenting his product by using pictures of Authentic wald EX spoilers while he's selling knock-offs.

Looks like Ed's picture was taken off the auction. I do see Zed's car on it though!

A excerpt from the following document linked at the bottom of this post.

"Also, the law can be - and in most countries is - simply declaratory, i.e., the law may state that the author of an original work has the right to prevent other persons from copying or otherwise using his work. So a created work is considered protected as soon as it exists, and a public register of copyright protected works is not necessary"

BTW, I'm an ebay power seller. Ebay has the VERO program and they do take down pictures by request. I use it all the time when people steal my pictures. You want to stand apart from other sellers and it's kinda difficult doing that if everyone is using the same pictures.
