Test Drove 01 E55 Today...a few questions?

Few questions I had after driving the car. I will get a PPI before I sign the check...
Engine noise from drives side foot well area. Only when car is in gear...seems odd to me. Just had a few things like ECU and selector assembly replaced and maybe they didn't put something back properly... like sound-deadening?
The comfort seat bolsters were not working. Turned the car off then back on and they started working again. What could this be?
The drivers seat back rest moved forward when I pushed it to lean back. It would lower back if I hit the 1 on the memory button. Bad switch?
The drivers-side sun visor is broken. The door broke off and the visor it self won't stay up. The passenger-side visor also won't stay up. Is this normal W210 stuff? Not a major deal just curious.
Everything else is in great shape, leather is perfect, no paint work or over spray, only normal chips on the front for a car w/ 109k. Other than the above I love the car.
