I have a 2006 R350 with 118,000 miles and took it in to the dealer for recall work to be done replacing the cam shaft adjuster magentas and wire harness. I had a p0016 code and they said recall work did not fix it. It is the balance shaft gear. I was prepared for them to tell me $6k to fix, but instead the service advisor said "We are fixing it under warranty so give us 3 more days." I was floored. Certainly Mercedes seems to be slowly changing their stance on fixing this defect.

I have also been reading this thread. Have had the entire transmission replaced on '06 e350, but still seem to have a problem with a loud noise coming from engine area. I have taken it in and they say this noise is normal for this year. It's like having loud brake noise, it drives me crazy! Can someone check this vin numbers WDBUF56J06A945089 & WDBTK72F09F257573? I only have 49,000 miles on the E class, so i figured i would keep it a couple more years and give it to our son to drive when he turns 16.
My clk550 amg only has 32,000 miles on it, so i am worried about this issue.

The engine light has not come back on, but the noise is louder than ever on the '06.
My '09 runs great and no noise; at least that one is in the clear! She is stored for winter.

Thank you for all your help. I am scheduled Monday morning to go into the dealership again. This time Service Manager is going to look at. I will take the bulletin with me and hope for the best! I need to get to the bottom of this once and for all. don't want to end up dead on the side of the road somewhere. Hopefully they will fix it or take it on trade in.

I remember reading about this in the past. I have an issue with my transmission and have had to do my transmission service at the dealer prematurely and I had to pay that out of pocket even though I was still under warranty.
The issue at hand is that when downshifting from 3rd to 2nd, 2nd to 1st, the gear's get "stuck" and the RPM jumps up and lurches the car forward. I've taken it in to the dealer more than 4 times and MB was able to finally replicate the issue but couldn't do anything about it since the car didn't "throw any codes." I think that's complete bull**** and was so pissed off when they charged me for the transmission service. Does this class action suit have anything to do with this issue. I read the link provided by the OP but it doesn't seem to pertain to my problem..just thought I'd ask if any one else is dealing with this problem.
