New car hit. Seeking advice.
At 5 PM yesterday we picked up a new 2014 E Class. Today at 11:30 AM the car was hit broadside by an Escalade pulling out of a gas station. No injuries. At a minimum the passenger side front fender and both doors need to be replaced. Car had under 75 miles on it. Other car was insured by State Farm. Escalade driver was cited by police for failure to yield from a private drive but she denies limitability for some reason. Police says she has no chance being successful.
Not sure what to expect as this moves toward resolution and am seeking advice from you all.

Best to let your insurance handle it at this point since she is denying responsibility.
Get yourself into a MB approved body shop and let State Farm do its job along with the police report.

I'll scratch the five items, and instead, here is a simple list of "Dos and Don'ts."
I suggest you talk to a local attorney. Insurance companies are no friend of yours.

Don't forget to insist on a payment for diminution in value. Even if fixed perfectly, this accident will show up when you try to sell it, so it is worth less. For a brand new car, considerably less.

I agree with Yidney on pursuing diminish value. I personally went thru this when a Jeep Liberty committed suicide against my ML350. Did over $10K in damage on a vehicle that had a street value of $43K. Liberty owner was insured by State Farm. Was quite a lengthy battle. Had to go thru all the "steps". Eventually recovered over $4K. Tried to find lawyer but no one would touch the case without any personal injury involved which there wasn't. If you mention getting a lawyer to State Farm, they will clam up and you are done. That move gets you nothing. I would work getting the vehicle repaired first. Then, you will have to get a an appraisal (be careful and don't get scammed here) because State Farm will require it. Then, you will need to get past the claim agent. Many calls here. Trade it as is before the repairs. If it was a $40,000 car before and they only give you $35,000 after you have reassigned the insurance check to them, sue the other driver for the difference.
Under no circumstances should you accept a brand new car with 75 miles as being made whole after extensive repairs. The car, the paint will never be the same. It will forever show an accident history on the Car Fax.
Insurance company could be asked to participate in a replacement car. Sometimes large repairs and subsequent supplemental repairs could require you to drive a rental car for 45-60 days that could cost the insurance company a lot of money. That money could be used in trading you out of the wreck.
Very sorry to hear about your accident. Just having picked up a 2014 E250 three days ago, I have been thinking what I would do if it was me. I am sitting here with 110 miles on my car.
