2019 E class part unavailable until May
Unfortunately my 2019 E was in an accident in early Jan. To make a long story short I've been told a part won't be available until May and my car is at a Mercedes dealer until then. Dealership has to be involved due to the complexity of the electronics. My insurance co has ended my rental days, and I'm without a car. Dealer says no rental because "I didn't make an appointment" and "Insurance is paying and I'm not." When asked if this happened based on a normal failure would I get a loaner, they said yes. The amount of the payment they are getting is into the thousands. Has anybody ever been in a similar situation waiting on a part? What has the dealer or MB USA done, if anything?

Insurance companies do this all the time. They say their "policy" is only X days rental. Usually you can push back hard and they will cave. If your state has a insurance commissioner a threat to go there can help.

Isn't that a question of who was at fault? If it wasn't your fault, I guess you could make the other insurance company pay. If it's your fault, they can just say you only paid for 30 days worth of rentals.

That depends on where TugboatBill resides. Florida is a no fault state and I believe there are others. In a no fault state each party make claims to and is covered by their own insurance.

I am also in a no fault state, but when it's the other driver's fault, the insurance company doesn't really push back on the length of the rental because the other insurance company will eventually foot the bill. You just say things like, I want to be made whole.

No fault insurance is your insurance pays for the repairs and they waive the deductible if you are not at fault. They do not collect from the other guy's insurance. This was instituted to save on all the legal costs of collecting from the other guy. We have that system in Ontario.

If they are paying for a Mercedes which is much more expensive, have them pay you directly and rent a econobox and spread out the payments. If the other insurance is at fault, make them pay it. In my state I can take my car to whoever I want. Call other dealers and ask about the part, they might be lying to you.
