I believe that rotors are considered a "wear & tear" item. The problem is they shouldn't have worn out after less than 10k miles. I don't know if I've ever heard of rotors lasting less than 50k other than age related, which isn't the case here. The dealer &/or MB should make good on it.

I've always replaced rotors when I replaced the second set of pads or at about 100k miles.

Not clear if rotors were rusted upon delivery or it developed during 3 months of ownership. If it occurred during ownership it comes down to dealer discretion if not, read on.

Your matter is considered wear & tear under 4 year/50,000 mile factory warranty however, I believe this vehicle is considered new regardless of mileage or time elapsed because it was never registered/titled to a private owner so in effect you can argue it should have had a pre-delivery inspection (PDI) requiring visual inspection of brake discs for corrosion. I attached 2021 CLS PDI (only one I have on hand), same for all models. Also, I believe MBUSA warrants defective brake parts for 12 months/12,000 miles on new vehicles which is probably why dealer has so “generously” offered pad replacement.

Bulletin 123a, if discs are replaced corrosion on hubs must also be removed.

Be prepared, dealer may counter no corrosion was found at PDI and/or you caused corrosion per attached bulletin 109, car wash, etc.

@konigstiger Thank you! Your posts are always enlightening.

Are all MB loaners not titled and sold as new? The loaners from my dealer have normal Florida tags. Dealer tags have the word "DEALER" on the tag instead of "SUNSHINE STATE" or the county name.

That woman was entirely too nice...

As long as this car has an in service date less than 1 year ago, this stuff with the rotors should be corrected free of charge. I've had this happen with other brands.

You are correct and why rotors are not considered a "wear and tear" item.

If defective they should be replaced under warranty.

In order for the lease to be competitive, title to the cars were never transferred, so as far as Mercedes is concerned leases on these cars are the same as a new car, but with extra depreciation based on the mileage.

This is why you never hear of leasing a used Mercedes: the depreciation on a used Mercedes, even a CPO, is so great that - the residual so low - that a new Mercedes will lease out for less, not more, than a new Mercedes.

I agree with konigstiger: a pre delivery inspection should have found this patent problem and it should have been corrected before delivery.

Stick to your guns: If the dealer will not fix the problem at his expense, diligently follow us with MB USA.

Tbh, the rust on you rotors seems normal for a car that is parked outside exposed to the elements. It looks like you are not using the brakes hard enough to properly remove the rust when you drive. Performance brakes like the ones found on MB vehicles work better with hard & short rather than gentle & long application of the brake pedal.

I recommend rebedding your brakes using the procedure outlined here. This should fully remove the rust on the rotor contact surface and eliminate the squeal.
