Yes, sounds like an issue with the capacitive wheel. It's sensitive, for sure. It'd be worth replacing the wheel. I'd take them on a test drive and show them, that way they can't just say it's normal operation. I don't have the gaze tracking camera on our EQEs, but a simple 4-finger hold at the bottom of the wheel, palm down near the center bottom spoke, is enough for hours of nag-free cruising. Hope it's resolved for you!

From page 247 in the owner manual:

Touch detection The driver is required to keep their hands on the steering wheel at all times and be able to intervene at any time to correct the course of the vehicle and keep it in lane. The driver must expect a change from active to passive mode or vice versa at any time. If the system detects that the driver has not steered the vehicle for a considerable period of time or has removed their hands from the steering wheel, an optical warning will be given first. Display 1 will appear on the driver's display. If the driver still does not steer the vehicle, or gives no confirmation to the system, a warning tone will sound in addition to the visual warning message.
