Lemon Law? Sue? Mercedes Sucks!

My GLE63s have been in the shop since October of 2023. Mercedes Benz corporate told me to kick rocks and go through the warranty process. They said I am not the first owner so I am at the mercy of the dealership and the parts coming. It needs a full-body harness and going to be a massive job. I am paying my monthly note on this car with no car in return. I have contacted a few lemon law cases and most of them said either they cannot do anything since it has too many miles even though under warranty or since the repair is still open, it needs to be closed out. I honestly getting extremely frustrated with how I have been treated by Mercedes as a company as I have 3 other MBs in my house. I feel like any other brand would have stepped up to help a customer especially since the car is still under factory warranty. Has anyone gone through this? I am thinking of just doing small claims court for the max amount of $9,999 but don't know if Mercedes will deny any other further case if I can get a lawyer to take this case.

That looks like a major job and not something that commonly fails, so they likely don't just have a spare harness sitting around somewhere. You'd probably run into this with any other brand as well. Gonna have to wait for the part. Not sure what else to say here. I don't believe the lemon law applies to second owners. As an AMG owner you have a direct line to corporate through the AMG Private Lounge. Post in the AMG Support group, but be professional, and the team will likely try to expedite the process from their end.

I mean I have kept my cool and dealer is even surprised cause no one would wait this long personally.

how do I access private lounge? It’s my 6th AMG but I never signed up

You go to the AMG website and the registration link is about half way down the page. If you register as an owner, you have to provide a VIN. There are a bunch of groups that are only accessible to owners such as the AMG Support group. The whole site was recently redesigned. Used to be more like a forum and they are still ironing out the rough edges, but the team continues to be responsive to issues.

BTW, your dealership also has ways to escalate this up the chain at AMG. This might be more of a case of an incompetent dealership.

yeah man. I just can’t believe MB is like this. Even BMW told my BMW dealer to pull a car out of inventory so it’s same car I have for loaner and gave me 2 months of payment reimbursement.

MB flat out said we aren’t required to help, go through warranty and wait however long it takes

When I had my 2020 C63S AMG Coupe in the shop for about 4 months while they were troubleshooting and waiting on parts for an eventual engine head replacement, the dealership paid for my car payment while it was out of commission. It is not something that the dealerships usually volunteer for but it is an option, you have to "ASK FOR IT" or they will not offer it to you. luckily I had a great relationship with someone high up in the Dealership management and they kind of beat around the bush and made suggestions about it until I understood what they were suggesting that I "Ask For".

I just gave them proof of my monthly payment and they sent me a check worth four months of payments!

I would suggest you get in touch with someone high up in Management at the dealership and ask them about compensation in the form of car payment reimbursement for the inconvenience of having your car out of commission for so long.

Yup! I asked about this and Top Dog in service said the dealership isn't required to be reimbursed. It needs to come from MB Corporate. We aren't responsible for the issues you are having as we are just the shop handling it. I understand but man, this has been a pain in my *** now.

You can still lemon a used car under warranty provided it was purchased from a dealer, I think, at least as far as I’m aware. Maybe it’s different per state. Did you buy it from a private party or dealer and what does your state law say?

I live in NC and their laws only protect original owner, no used cars

I bought it from a dealer out in Georgia. Maybe I can contact Georgia lemon law

I did sign up for AMG and someone reached out rather quickly.

My issue is, even if I think this dealer is being stupid. I cannot pull out the car to another dealer cause it will just reset everything. Even if they confirm oh yeah this is the issue, the harness will go back to square one so I don't want to add another 5-6 months into this ordeal.

My 21 GLE63S was in the shop from June of 23 until November. MB did respond to me. The email said my case was escalated and I would hear from a representative in two days. Two weeks later I finally received a call. They apologized for the delay and said they would check on the replacement parts to see if they could assist in expediting the repairs. A week or two later they called again and apologized and said they could not expedite the parts for repair as they were globally unavailable. They said that upon completion of repairs they would compensate my loss of use for the vehicle. I have reached out multiple times after receiving the vehicle back and I can not get a response. I have emailed and called. It is very aggravating. I DID move the vehicle from one dealership to another during this period as not only did the first dealership fail to repair the vehicle but also their 23 year old tech took the vehicle joy riding over a weekend driving over 100 miles and exceeding 100mph after midnight. This occurred in NC. I lost the use of the vehicle for five months. Almost three of those months without a loaner vehicle. Five months loss of use, five months of subscription services lost, five months of warranty coverage lost and no further response from MB customer service.
I wish you better luck than I have experienced. I will attempt the AMG route but I do not have high expectations.

I got paid out my monthly payment times how many months it was in the shop + 20% after I got the car back. I loved the car but there was small creeks and crack noises from interior being pulled. I just sold it for a X7. Didn't want to deal with going back to the dealer over and over.

Took 9 months from start to finish sadly. My dealer was great (MB of Raleigh) and gave me all the nicest loaners

MB of Raleigh is great IMO and that is who did (finally) repair the vehicle correctly. They said they did not have a loaner available but were very responsive and quickly sent a rollback to get the truck and it appears they correctly evaluated the issues and completed all of the repairs. It appears there aren't any creaks and rattles so far but it is rarely driven now and has become a garage queen. The S580 is much nicer anyway
