Why doesn't the tailgate closes, once open on my ML350?

Why doesn't the tailgate closes, once open on my ML350?
My ML350 I hold the key remote the tailgate it open, press the door button it open, pull the handle on the tailgate it opens. However neither one closes it. Why is that?

Could be a fault in the system, have you had it scanned?
