First off, XPRO sounds to be in line with NOTKTS and CLAYJ.
There's no way this story could have happened, first driving recklessly while under the influence AND evading? That's some serious **** right there... He would have had to have had a pre-trial arraignment and then wouldn't be released until he plead before a magistrate, they simply wouldn't have let him go that easily and ROR at that.

That's exactly my point - your logic is based solely on common sense, not legal sense. Those are two quite different things. If common sense dictated how the law was applied, XPRO would not be in the situation he is in right now.
Above you said "They instigated a race thinking that someone in a new M5 was ready to run." If you follow your own common sense logic - a rev is an invitation to race. Its not like the other driver doesn't have a choice. Does everyone race a car thats revs at them at the light 100% of the time? No.
Instigation implies something more that pressing the gas pedal while the vehicle is in neutral, thereby making the engine become louder for several seconds. How can you know what they were thinking? I'm not willing to make any assumption about the cops' intentions - only guesses, as I was not there.

XPRO BTW: Drinking and driving not good no excuses as far as street racing not good either, go to the track. Accidents are just that. You may think the coast is clear no other cars etc... What do you say to the mom whose kid you just flattened? I didn't see em?

Wait...someone please correct me if I'm wrong...but isn't that considered entrapment or someting like that? A cop can't force you to do something illegal and then get you for it...no?

It's not considered entrapment down here. In fact, there are a few cops who go around and race off the stoplights. Glendale has a couple black Honda Accord V6's with dark tint, I bit the bait on a white Z28 in Northridge, and another area has G35 coupes (I don't remember where it was).

Even though this is an old thread, I just wanted to say that I have also encountered undercover cops in fast cars.
At the local car meet/street races, back when the new Mustang GT was first released, it rolled through revving its engine and everybody was looking at this new mustang. The guy gets out, walks over to another car and pulls a flashlight and a badge and starts inspecting cars.
When I was at AI Design in Tuckahoe they were working on a tuned black M5 that had the lights in the grill and was used by undercover cops.
I have also heard plenty of stories about cops who roll around in riced out eclipses and stuff.
You have to be very careful now-a-days.

See the thing is I had plenty of time to sober up before I called it the night... The officers tried to make me sign paper work and I cheerfully rejected it, exercising my rights. I was very calmed and poised. They ended up nailing me for Reckless driving under suspecion of driving under influence though they can't prove it with out me taking the breathalizer test or signing any type of confession. I got nailed for evading the police which I told the police that I thought I was in danger when I saw the vette trying to impersonate a law enforcement officer. Of course my license got suspended for refusing the sobriety test. I've contacted my lawyer and I think everything is going to alright. "Woman" and I has yet spoke for a week now.

He has no case to defend. Refusal is automatic suspension - no trial, no plea bargain, no nothing.
