I found it rather easy to get my hands on this information. As an E46 M3 owner, you should know this.
The E46 M3 is known to have relatively inaccurate speedo.
E46 M3 speed limiters are based off a sensor in the differential, and not the actual speedometer. Therefore, the limiter will 'engage' in a specific gear at a specific engine RPM.
As a result, if you surpass the 'limiting speed' (i.e. 155mph) in 5th gear, and then shift to 6th, you can easily surpass 155mph. The limiter kicks in at ~6,500 rpm whilst in 6th gear.
That corresponds to ~175 mph.
Time to move on.
