I still say you approach the dealer and ask why the frame damage was not disclosed. They surely knew about it when the for it from the auction. And frame/ unibody damage auction block indication is always just that- the vehicle is junk.

That Malibu assuming average condition is $10k wholesale. The truck assuming average condition is $20k wholesale. Unibody damage flag is automatic 1/3 if not more off so this particular one is $13k. Rough numbers.
So... They gave her $4k more on her trade in (since there is so much cushion on the buy side) and sold her the truck for a tidy 50% or $10k profit. That sales person ended the year with a bang.
After 2 successive deals, it's best to pause and just catch up on paying down the negative equity rather than adding to the pain. Each transaction is costly and aggravates the problem.
Let's look at putting the $200 / month from the canceled warranty into the payment. In 10 months that will eliminate over $2,000 in principal, plus as you get closer to payoff the amount of $$ going to principal increases. The Explorer probably had a lot of highway miles at purchase and will probably be ok for 10 months. Then you will be closer to $20k owed and have less negative equity.
If you can hold on for an additional 10 months, you'll be at $10k owed and roughly even with the then current value ( a check on current wholesale on a clean 2011 Limited with 95k is 16k
subtract for any significant reconditioning, a wild *** guess on wholesale with the repaired minor frame damage may subtract a few grand from that value)
You should be sure to keep collision and comprehensive insurance on the car since Vancouver is known for flooding.

Btw, there is a rubbing noise coming from the suspension where the accident was she takes right rights of goes over speed humps.
The dealership took full advantage of her.
When talking to the dealership manager, I said "You would rather speak only to her because she's easy.."
The manager tried to use that as leverage to get her to trust them more. It was hilarious.

I'm at the dealership getting that crush prop serviced for the last time.

Really though, I've been sitting at the dealership lounge for 2.5 hours for this oil change/ tire rotation.
I requested the the rotation cause I can do the oil change myself from now on. Ill get mobil1 from WalMart for half the price of this dealership and could have been home two hours ago.

Two years later She's almost down to what the car was worth when she took a loan on it two years ago!
I've given up going the legal route. Giving them more business as too.
Shes going to have to drive that thing into the ground. I hope she learned not to go buy the second largest purchase one can make alone again.
