Alright so here goes the update.
I filed out an online form to the D.A. specifically for Car Dealer fraud. The DA took my case and the dealership responded within days.
They took the Explorer back, two years and 35k miles later and returned all $28888 in the form of a 2012 Acura MDX(like she has wanted for a few years) with lower miles.
