received an email similar to the one you got terminator, total horsefuel........but I didn't have high expectations.....


I'm going to a different dealer tomorrow to have the 'change key battery' issue addressed as it's finally getting really annoying.......
also going to purchase an ELW for my CLS......funny thing is I was contemplating buying it from Cary, but they don't need any of my money haha, as they don't like it when customers get pissed off or want things their way

What surprises me in situations like this one is the total lack of common sense on the dealership’s side. At the end of the day, each party has achieved the target objective: the customer got a lifetime denial of service, while the dealer got a lifetime hater. It is a win-win situation. :-)

From my perspective, I still don’t know what I have done to receive such a treatment. As a result, I will be sharing my bad experience with MB of Lynnwood for as long as I live. They will have to terminate me, or go out of business if they want me to stop doing so.

I still keep thinking about this and if it were me, I would say "Fine. You won't service the car I got new from you, here's the car, refund ALL of my money." This just seems like a slam dunk case to me. Shove the car up their exhaust pipe and go get a new one from another dealer. I feel you are letting them off the hook too easy here, but hey, that's just me.

I'm not sure I would know what to do, the car is a 2014.....it's not a lease.....it's paid for and done
how would you proceed?

If you have an attorney friend, I would bounce it off of them. We must have some lawyers on this site, maybe they could chime in? How can a dealer sell you something that requires their service and then they deny you that service, while the car is still under warranty? Come on guys, give us some free legal advice.

I don't see how you would have any legal basis to return the car. You are free to have the car serviced under the terms of the MB warranty at any other dealer in the area. They are not precluding you from receiving service, just exercising their right to deny you service.

I agree, I have already gone to visit another one, like I mentioned before.....it's a '14 with over 20K! who the hell would want that back lol

I can only imagine how abusive you had to be for them to exclude you from a dealership. Three sides to every story.

Personally, I don't pay my employees enough money to be abused by an irate customer, no matter the situation or fault. **** happens, you fix it and apologize. Continual **** happens, you take your business elsewhere and I go out of business. You don't abuse an hourly employees because you are upset.

The fact that you believe the amount of money you spend gives you some sort of right to use abusive language makes me really want to hear their side of the story.

I understand Mike450, I honestly think they're blowing it a bit out of whack.......I did confess to being rude, and also apologized to those involved......this goes beyond the hourly workers......they were people I was okay with.....this is merely the doing of ONE butthurt man......you do know dealers never lie

Well, they may be doing exactly that, I don't doubt, but I have to believe they are in their right to refuse you service, unless it is specifically addressed in their franchise agreement.

But put yourself in the dealer's shoes. You have employees, that feel they are being unjustly abused by a customer and the owner just sided with customer. They now question your concerns for their overall well being. Not exactly the morale you want to perpetuate in your shop.

Sometimes you gotta suck up and deal with the situation you have created. Maybe a lesson learned.

I appreciate your response to my post btw. After a few moments, I got to thinking maybe I should re word my thoughts ...lol

I guess it is their right to refuse me......I can't hold MB responsible.....I still like my cars, and the place I just bought my ELW from is nicer, newer and has people I can work with. AND TRUE, I have certainly learned several lessons from this whole ordeal.......one of which is money doesn't talk anymore these days...
sure I can understand the workers not wanting to work with me: my reply is......do the fawking job right the first time and don't dick me around while doing it......and things should be fine....I listed several of the obstacles I faced during my time there.....

Well, this is not entirely right, and probably varies state to state.

While they do generally have the right to refuse service to anyone, it can't be arbitrary. There has to be a good and justifiable reason, and only a judge will reach that decision.

Also, MBUSA is probably not off the hook on this either.

It all depends how far you want to take it.

the good and justifiable reason was my being too rude to employee's, on more than one occasion, and after asking so many times, they never told me exactly why aside from excessive rude behavior, what else would I do? Who else would I write to? Someone suggested Dieter himself, but does that seem like a good idea?

basically they said the dealers are independent and can make their own choices, and recommended I find another one to have my cars serviced

Guys, what are you really trying to do? Bury Hyperoin?. There is no case here, as I'v stated before, arbitration/mediation is the only route, whether the BBB, MB customer service, or a mutual friend to the dealership.

What are you going to go and tell the courts? Probably the dealership will have 5 witnesses to present against one Hyperion. What if one tips off the local news station or a reporter. It will make juicy news stories (like affluenza teens), "rich Mercedes owner fingers poor mechanic and then sues them in the court" or "Fat driver refuses to travel extra 5 miles to next dealership even after abusing a handicapped mechanic". No judge is going to end his blossoming career and rule in favor. I think Hyperion is wise to recognize that its time to atone rather than escalate. Contact BBB and ask for their "mediation" service.

I don't know how you can be so sure. Hyperion said he used "bad language." Doesn't sound too bad to me, but don't know the details.

In any event, without more information, how would you know. One thing is for sure. They can't sell you a car, take your money, and then, without sufficient cause, refuse to honor warranty service.

One question I'd like to know if he was warned by the dealer, prior to taking action, that his behavior was not acceptable and needed to change.

I prefer to fight with loaded guns. It all depends upon your approach and style. I am not suggesting that you initially act aggressively, but they should understand this is important to you.
