Bad Outcome for Bluemax
On a sad note, he accepted a plea bargain and has pled guilty to manslaughter and will be sentenced in May. Wondering if it would do any good to write letters to the sentencing judge as to why only a minimum sentence should be imposed? There was a witch hunt mentality after the accident, and the investigators and prosecutors seemingly ignored the fact that the accident involved a failure to yield right of way.
Admins, feel free to delete this post if necessary. Since the matter is now adjudicated, though, thought some of the older members might have an interest in the outcome. Very sad for all involved.

That link you provided is interesting. The other guy gets the possibility of a lesser sentence but yet he was just as guilty. Doesn't make any sense to me.

Sorry to be harsh, but I think he deserves what he gets. That could have been my wife and kids in which he whould have been imposed the deateh sentence. Just a lesson to all in street racing. Write all the letters you want in this country right now, street racers are getting the max and that a good thing in my opinion.

I agree with your comment. What I don't get is that both racers get different treatment.

Well if alcohol was involved in one and not the other, that explains it. Drag racing is bad for this reason, drag racing drunk is another situation. They probally charged him with "aggravated" vehicular homicide.

I think Bluemax sounds like a nice guy, but unfortunately his poor judgment cost another driver his life. I'm not going to say I haven't engaged in a race or two, but what really is a sympathy deal breaker for me was the involvement of alcohol. That is really a very, very, very dangerous mix. I really think it's an unfortunate situation but the fact that he was drinking beforehand... reckless :-\

You cant fault someone for pulling out infront of him, there is no way the laymen person can judge closing distance at those speeds. He probally lookd and assumed they were doing a little over the speed limit but not the tripple digits. People in America fail to realize driving is a privledge not a right. I hope he goes to jail till he is too old to drive personally.

We always talk about right place right time, this is definitely wrong place at the wrong time.
Just talking about being in a crash like this with street racing being so publicized. Ole Blue is gonna get a "message to others racers" sentence for sure.

I agree with everything Emoving says...if you are adult enough to afford a high priced powerful sports car then you should be adult enough to understand that drag racing is a huge threat to the safety of innocent people...i feel sorry for everyone's families...those are the real people that suffer

Marijuana doesn't affect driver judgment, there some research on it. But to each his own as everyone gets a different side effect.
The guy was 75 year's old ofc his judgment is impaired.

Hey Blue, I have good memories of you around here and I wish you were posting under different circumstances. It is incredibly sobering to see how such a seemingly innocent decision can so quickly change the life of many people........just tragic.

Because he admitted they were racing? It says his truthful statement reduced his charges. So if Van Burkel gave that testimony it would of been Aricona charged with Manslaughter?

Yeah, the accident wasn't caused by him being impaired, it was due to the old guy turning and not giving anyone enough time to brake -- impaired or not -- as seen by the guy who he was racing, but not high also being involved.
This is a case of wrong time, wrong place. What if they HAD been going the speed limit and just happened to be closer? There would still have been an accident but the old guy might have lived due to it being lesser speed; but either way it was the old guys impaired judgment which caused the accident.
You KNOW when someone is driving fast, if you are not able to distinguish that, then you shouldn't be driving as you are a danger to everyone else as much as a street racer is!
