Woah! Looks like I am late to the party ... Shardul has not only been an asset to the forums and all members but he has also been an asset to the sponsors too. He has given me sound advice and put me on to Forum sponsors and even offered to coordinate communication. I don't know all the details of what happened but all I know is he is an asset to all of us and really should reconsider suspending or banning...

I think most readers here, including me, think suspending Shardul was a bad move. He has probably helped all of us at one time or another. So yeah, I'd like to see his access to this forum restored too, with an apology from IB and whichever vendors were also involved.

But there's a bigger issue than Shardul involved. And that issue is the need for IB to provide more detailed guidance regarding what constitutes "commerical purpose" under IB's "Terms and Conditions of Use" for this website.

The TOU says in part:

"Without limiting any other provisions of this Agreement, you may not use this Site for any purpose that is unlawful or prohibited by this Agreement and/or any applicable additional terms. Your access to this Site may be terminated immediately in our sole discretion, with or without notice, if you fail to comply with any provision of this agreement and/or additional terms, or for any other reason, or no reason. You expressly agree not to:

Use this Site or its contents for any commercial purpose;
Access, monitor or copy any content or information of this Website using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;
Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionate burden on our infrastructure; and
"frame," "mirror" or otherwise incorporate any part of this Site into any other website without our prior written permission."

Perhaps a rep from IB or this forum's moderator can detail for us exactly what constitutes "commerical purpose" with respect to this forum. Is it developing improvements for our cars and sharing the information with forum members? Is it specifically advertising a product or service on the forum without being a sponsor? What exactly is prohibited? As it stands now, no one seems to know for sure.

This entire forum has always been about people sharing information about ideas and products that work and don't work for our cars. Maybe if instead of relying on an intentionally vague TOU to arbitrarily "punish" useful members who may have come up with better ideas than some of the overpriced "vendors" here, IB would actually provide some additional guidance around its "commerical purpose" policy and how it's applied, we could end up having less silly drama around here. That's my take on it.

But what worries me the most, if true, is that the suspension was due to inappropriate PMs, not selling in the open forum. So, does that mean the moderators have the ability to, and actively are, reading our private messages? Or was one of these alleged inappropriate PMs, forwarded to the mods?

I think it's time that somebody from here, should at the very least, chime in on what the infraction was, what rule he broke, and how it was brought to surface. I'm not so sure that we should expect for the vendor to be named, but at least clear up what's going on.

Vic, as I believe you're one of the last few remaining mods that are "By The People, for The People", can you at least tell us something? C'mon man, I know in your heart of hearts, you know Shard's shouldn't have been suspended. I understand that you have to tow the company line in the open forum, but if I were a betting man, I'd bet you're on our side.

You can PM me your feelings....oh wait....no you can't. Nevermind....

LOL. can someone tell me what is it all about? So far I read that some member on this message board was selling parts and he wasn't allowed to do so, because only sponsor(people or company that pay fee) can do that. am I missing something?
