Just be aware that when you enter into a class action lawsuit you will (1) likely forfeit any way to get your claim settled any other way with the dealer, MB, or your warranty company, (2) enter into a process which may take many years to complete, (3) if the suit is decided in your favor, most of the proceeds will go to the attorney, (4) whatever is leftover will be divided amongst the rest of you and will very likely be negligible. Lots of class action litigants are awarded coupons for future purchases, for example.

Soooo im reading this just after leaving a friends shop...(Mercedes only). He sees my 05 E55 and walks me to the back to show me a fuel tank from a 211.
Here is the interesting part. While it looks like the leak is from the sending unit, it is not. Thne leak is in the center top of the tank and runs down into the sender pocket! It is one hell of a flaw. The only fix is to replace the tank!
Only way to diagnose is topull out the tank.

^^^^^ this. i just had my tank replaced under extended warranty.
very expensive (only cost me $100 deductible)
problem is now solved

W209 with same issue
While I have an '04 CLK500, I am currently experiencing a similar problem. Car was towed to dealership yesterday so more details should be forthcoming later today. In my instance, fuel was actually puddling up under the car - dripping from rear, which I don't see as a complaint here, but strong smell in the cabin. KA BOOM -

Add me to the list also..I have 3 kids one is 4month old and I can not take them anywhere more then 25-30min of driving because the fumes from the tank get so bad that it chokes me alone

Update: According to the dealer, there is a plastic 'nib' at the top of the fuel tank....why there is plastic on a fuel tank I do not know....anyway, that plastic piece was allegedly damaged by road debris. I was told that the shrouding around the fuel tank typically protects this little nib, and that the only way it could have been broken off is by hitting something on the highway. I do not recall any incident, but it was acceptable to my insurance company who paid, less a $500 deductible, for the very expensive repair. Repair involved removing entire rear end of car to access and replace the fuel tank and all of it's mechanical components. The story has a happy ending, however - once I had my car repaired and returned after 3 weeks I immediately traded it in....on a Fiat 500T.

Received two last week.

Other is to meet at my local Benz dealership in December.

Have the same issue I was rejected by the dealer and was quoted 3,500 to fix I just don't ever fill my tank up i usually smell gas if I have full tank now I usually don't fill up more than 40$

Add me to the list please...or what do I need to do? My car is pissing fuel out from the sending unit, near the connector, and out the bottom of the car. I removed the round cover the other day after smelling fuel, and the aread where the sending unit is on was full of fuel. Is this what you guys are also suffering by?

Could you kindly add me to the list as well? same symptoms....after fill-up and being parked inside the garage, a strong distinct odor of gasoline would emanate throughout the garage. My wife smelled it right away also and confirmed I wasn't imagining things.
Luckily, I bought our W211 E63 AMg with extended warranty and they replaced the fuel sending units. we got the car back last week and so far so good.

I thought I was imagining things, I still have an extended on my e63. Want to fill up and test this issue before heading down to the dealer.. So what is the correct way to fix this issue? Gas tank or fuel sender units?
