"New" E63 with 9000 miles?

Hope I am not violating forum rule when I discuss prices in detail. If I am, please let me know.
After dropping off my '10 Subaru Legacy today for two minor recalls, I requested to be dropped off by courtesy shuttle at a nearby MB dealer within the same huge auto group. I just wanted to look around and see if they have the 2012 E-class brochure because my intention was to decide after I have a chance to test drive the 2012 with M157 engine. By the way, I just test drove a new 2011 E63 (really low miles on odometer) one week ago at a dealership near Chicago.
Surprisingly, a 2011 E63 was just traded in this morning for an S-class 4matic due to the owner wanting more control in the winter. Shortly after, I was told this car was actually driven by one of the group's executives (options picked out by this executives). It has never been registered to anyone. Thus it is considered a "new car???"
Here are the specs:
2011 E63 paladium silver; around 9000 miles; P2; 19" wheels; carbon fiber interior trim; (also I was told it has Distronics pkg even though I didn't see it on the built sheet). There are clearly scraps on the right lower front chin/apron; and possible light curb scrap on one of the rims.
By the way: they offered $16.6K for my 19K miles '10 Subaru Legacy 2.5 premium w/ all weather pkg.
One of things I brought up was if gas-guzzler tax still there since the dealer call it a "new car;" they told me they are swallowing that cost into the offered price. Six hours later, I was confused, nervous, and exhausted. Thus I left after telling them I really need to do my car buying homework and sleep on the number. But I told them I would call them back and let them know.
Their original offer was $92K, then it went down to $89K. That amt did not include tax, docs, etc which will amount to be around $5600. Within the $5600 are also $300-400 of etched "theft avert" (which I refused to buy) and $59.99 for nitrogen in tires (which I was told I could not refuse because 'it's in the tires already'). Towards the end, they told me they might be able to give me another $1K for my trade in. I hesitated. So they show me they will give me another $1K coupon which they are sending to all of the dealer's previous customers. I still hesistated. Oh, and they will give the car a free upholstery (with 5 years warranty on the upholstery after treatment) and paint sealant treatment. Upon my further hesistation, they also mention throwing in $2000 towards winter tires/rim purchase at tirerack.com (personally I would rather them just take another $2K off). They will be likely losing money on anything lower, I was told.
So I guess it will actually be $89K + $5600(tax,fees,docs,etc) - $2K(tirerack) - $1000(customer coupon) - $17.6K(my trade in)= $74K as walk out price.
I just did not feel good about them calling it a "new car" with 9000 miles. I did not feel the gas guzzler should be there. I feel I might be taken for a ride but I was not sure about my feeling. At the same time, I feel bad I have wasted their time; despite me repeatedly telling them I didn't have the numbers in my head and did not want to waste their time. I feel my head is spinning.
What do you all think? Really sorry for the long post and details.

rip off.... wtf does paint sealant mean, come on now?
if u search online u can find some low milage cars for 75-77K,
u might be better off with a CPO car too because you would get another yr on warrenty and 100000miles
plus scrape on apron and crap like that is not acceptable for a new car

Run away and never go back there. They are trying to rip you off. That's what a new car should cost, not a used one. I paid less than that for a brand new one in 2010 and others have done the same recently on this board.

Dont let them intimidate you or try to make you feel bad for wasting their time. I dealt with a dealership for over a month ordering my 2012 e63 and used a lot of their time figuring things out, turned out they were not as professional or knowledgeable as i though and i put em in the trash and ordered the right car from another. And if u are looking at that price range for a close to new car, buy one new!

Don't do it! A dealer tried to do the same thing with me. I ended up with a new one June of last year with a msrp of $102,425 (20mi. on the od) for $89,000 and $33,000 trade in for my 2008 Jeep SRT8 with 26,000mi.
I know others got better deals after I bought mine as well.
The deals on 2011's should be pretty good with the 12's having the new engine

Don't do it! A dealer tried to do the same thing with me. I ended up with a new one June of last year with a msrp of $102,425 (20mi. on the od) for $89,000 and $33,000 trade in for my 2008 Jeep SRT8 with 26,000mi.
I know others got better deals after I bought mine as well.
The deals on 2011's should be pretty good with the 12's having the new engine

Thanks to all for responding. I'm glad I did not agree to that deal yesterday.
JY888, that car you bought certainly was new and has way less miles. So what's up with this $89K number?! It must be a magic number which they feel can mesmerize customers.
They tried calling me 5 times today and also wrote me an e-mail, wanting to "show me the numbers" and want to see when I can drop by the dealer. I replied to them I still need to think about it. Most likely I'm going to tell them I can find better deal elsewhere.
Yesterday, they kept on stressing that I'm getting a MSRP 100K+ car for $89K and what else they could do to the number to make it work out...while at the same time stated over and over they will lose money if they go any lower; and their E63 has all the options I wanted (Nope!). They just kept on repeating those over and over. They are not hearing me (or pretending not to hear) repeating I really want to compare the M157 engine to the M156.
I'm surprised they did not try to sweeten it by mentioning the free AMG academy basic course if it is a new car. Even then, I doubt I would fall for a "new" 9000 miles car with clearly linear DEEP scratch patch on the right front chin. My gut feeling just wasn't good about the whole deal, but I was bewildered.
From them, it sounded as if an exec would always drive a car carefully; and this car was somehow made more special after it has been driven by an exec. Yeah right, many of the wrecked exotics are driven by people with so much dough they could care less with what happens.

...and hearing the 2012's come w/ P2 already std in the car for that price, so you get keyless, xenon, and other options worth about $5k.

Yeah, the interior CF does look sick. But I'm not too crazy about it.
AMG academy cars?!?! That's a good point. That's a scary thought. Heck they will have to slash 2/3 off the price for me to even consider it. I think I'm gonna ask them for the carfax report but I doubt that will say anything.

I dropped by the same dealer yesterday to arrange for Tirerack HQ people to do the measurements for winter rim/tire set-up. They all gathered as if I have returned to buy the car even though that wasn't my intention. Still, they won't budge. They insisted that the car having never been registered to anyone precludes them, per MB dealer rule, from dropping the price below a certain level. It didn't make sense to me but of course there was no way I could verify that. Neither was I interested in verifying such a thing. Anyhow, I told them that car, to 99% of the buyers, is a used car with enough mileage to easily place it in an one year old car category; unless when a buyer goes there by accident and catch the "gotta-have-it-today" bug.
Overall, it is clearly a demo car. And we all know how heavily discounted demo things are at places like BestBuy. Before I left, I felt and examined the tread depth of the front and rear tires. Rear is obviously way worn down (compared to the front) to nearly the replacement bar on the tire. So I doubt the car had been driven lightly.

Personally, I think the group (quite a large one that has 16 different auto brands) is actually losing money when they continue to allow the practice of driving their own inventory. It's like smoking your own dope that you are supposed to sell. But I guess there are always people out there who will still buy them. Anyway, all of those cars get the dual personality of thinking they are "new" when they are used like all other used cars out there. It's crazy.

I have read some comments on google about that same dealer with one buyer from earlier this year complaining about it. The car he was buying was a Durango. So it sounds like they have that on every car. Of course there was no way for me to verify the content of the tires. I have a feeling there is nothing but normal air in there.

Yes, I have tried to avoid putting up the name of the dealer; in case they read about this and decide to bring me to the court for "defaming" them or something like that. I'll just tell you the dealer is located in Indiana. There are not many MB dealers here. So google the few dealers here for comments and you will quickly find out which one.
As for good dealers...I have come across this site called dealerrater.com. Not sure how reliable that is since they can go there to put excellent comments about themselves. However, it's a good start at least.
