2015 C300 4Matic cracked piston. Filed demand letter/lawsuit

Hello guys, I have the same issue.
2015 C300 4Matic with 59k miles (I’m the 2nd owner) and my piston 1 cracked and damaged the cylinder walls and now I’m in need of a new engine and getting quoted about $24k which is INSANE. Especially when I barely owe $9800 on the car loan. I hired an attorney and he told me that he’s worked many cases like this before and said that this piston is covered under the 7 year 70k miles emissions warranty making Mercedes liable for my new engine. He sent a demand letter out to mercedes benz 2 days ago to pay for my repairs or we’ will file a lawsuit. He gave them 30 days to respond. He said mercedes benz and many manufacturers have a bad habit of lying and misinforming their dealerships about many mechanical components that are actually covered under their warranties. However, he told me there’s a law here in California related to the emissions warranty on page 4 it includes the piston (I’ll attach the file) and said that the law is the law and the piston falls under that warranty. Therefore, he’s confident in getting my car repaired or winning the lawsuit. Great. I hope it's escalated to a class action lawsuit so that it can benefit us all. There was a similar class action lawsuit, Hyundai Theta 2 Engine. It's settled with cash compensations, repair reimbursement, and a LIFETIME powertrain warranty.

After Mercedes needing an extension to respond, they finally responded and know that they can’t get into a deeper hole. They now asked if I want them to repair my vehicle and pay for the inconvenience or to reimburse me for my car for the price I originally bought it for. Given this awful new vehicle market, I chose to repair my vehicle so my lawyer is getting back in touch with them and we’ll wait to find out the final decision. As of now the repair has not been approved YET.

hi, I’m so glad I’ve been reading about your situation because the same thing happened to me . My car is at the service department at Mercedes’ Ontario with only 51k miles and two days ago they sent me an estimate for a little over 16 thousand dollars . Unbelievable. I contacted Mercedes’ USA for help but the dealership didn’t want to help me . They said I was out of warranty and they could do any goodwill repairs . I also mentioned the emissions warranty but they seem to know absolutely nothing about it . Told me I have until Tuesday to go get my car or I’ll be charged storage fees. I don’t understand how they can so easily say that there’s nothing they can do to help when it’s clearly a design flaw. That wrist pin issue is what was causing our cars to sound like Diesel engines . The tap tap tap we would hear was the piston hitting the cylinder wall, this would also create lots of friction and would sometimes make the temp go up , after a while the poor thing couldn’t take the beating anymore and just cracked . Can’t believe they would tell us all that the sound was normal . I also found out that this particular engine was manufactured in Tennessee by Infiniti . Don’t believe me ? Look it up . I was also surprised .

would you mind giving me the contact info for your attorney . I’m also in California and could use their help. I’d really appreciate it . I’ve been so stressed out these past two weeks over this and reading your post has been a breath of fresh air .

please please file a claim with the NHTSA , they have the power to recall these cars and fix all this mess. I just submitted mine yesterday but the more people submitting the same problem will help in the investigation… a lot of us post our complaints and problems in these forums but we don’t do the same with the government agencies who can actually turn this all around . So please go to the website and file a claim . Everyone here needs to do the same . When I was doing mine it showed very few complaints being made about this . They need to be made aware about how many owners are having these issues . Also , Mercedes’ is in a way committing fraud because some of us living in California have the extended warranty that is supposed to cover this .

wow I’m so sorry you’ve been going through the same thing!!! It’s so devastating and stressful. I can’t believe the dealer at Ontario is really trying to kick you out or start charging you storage fees so soon. This is becoming a recurring issue - We bought our 2016 C300 used low miles at the time and still under 50K and guess what hole in the piston. We also had the fuel line issue and sunroof problem. My wife drives the car and travels to work 4 miles away - so it wasn't even driven hard or for very long. I am going to file right away with NHTSA. Could use an attorney sounds like it may be the only way to get it. We still owe money on this car loan.

im sorry you’re going through the same mess and yes, do fill out that NHTSA complaint and make sure to emphasize how unsafe it can be for that to happen to any car on the highway. Highway patrol did tell me that it’s a traffic safety hazard . I also want everyone here to know to cross your fingers because two weeks ago I sent an actual physical letter to the NHTSA administrator and it was a Defect recall petition . The difference between this and an online complaint is that my petition will assure by federal law that our problem will be investigated by the nhtsa within a certain amount of time (believe it was less than 90 days ) and if the deny it they are also required by law to state the reason for denial in the federal register . It’s something I found out about through by hours and hours of reading to figure out a way to make sure Mercedes’ takes responsibility for this problem . This problem is also affecting owners of glc300’s , metris vans and some other Mercedes’ models with the m274 engines . The more complaints we have on the nhtsa site , the better as they will see my petition and look for others with the same issue . I did send them screen shots of various complaints all with the same issue to get them started . I’m very confident this will be resolved so we all just need to have faith and hang in there just a little longer .

Update

Well, of course this dealer diagnosed the piston, said it would cost 14k to repair. Curious, that's the same amount I own on the car. They then told me the best they could do was 12k. When I told them no, the next day they offered to buy the car back, they offered 12k. So we took that offer, paid the difference and off car hunting for something new. Then on further research, apparently, in California, this would have fallen inder the lemon law. Nobody, mention anything about the lemon law, which states 7 years, 50k miles, for pistons. So maybe for others, instead of going the recall route, maybe the lemon law will work in your favor. I don't have the time or patience, so the offer to me was a quick solution, albeit not a very morale one from this dealership,. I'll still file the report for the recall....

MBZ southbay wanted $18k on my '16 C300 to replace piston and parts needed with 4yrs warranty. I declined. my car was $15k+ options with fully loaded with AMG package and red leather interior. loved that car, but couldn't afford to keep this repeating stress.

Sorry to hear about the issue you are facing, as for them getting rid of I4-turbo might not happen other than going 0 cylinders... by becoming BEV, which is part of their strategy. https://media.mercedes-benz.com/arti...2-0c09e3d16ce7
They even put an I4-turbo in the new SL 43 although that is their entry level SL though you still get V8s in the SL.

Yes, I saw that. key problem with modern cars now a day, they load these cars with FULL of technologies that most of general users don't or even know how to use them. or even needed them. therefore no car company can no longer produce reliable or decent everyday car.
whose want to spend $100k for daily use car and as soon as you drive out of dealer, your car values drop by 20%

well, I had to SOLD my 2015 C300 and 2016 C300 with average $10k lost from market price to CarMax. shame on MBZ.
