Dear OE,

Ask your lawyer about the gratuitous duty doctrine....

Sven never undertakes them.
Sven is living large, good for him and his boys.
the finger?

as a small business owner myself, yes it is possible for fedex or ups to lose a package. label comes off, box gets jammed in sorting machine and thrown out, employee steals it. there are numerous ways a package gets lost. i cringe when i look at the extra amount i spend on insurance i never use. but the reality is, it takes one claim for it to pay off. especially if you ship goods you dont own or goods you cant absorb the cost of, you should pay the extra for insurance. I have never had an issue with UPS or Fedex or even USPS not paying out for lost or damaged goods.

this is BS, at minimum you should refund the tune amount which is essentially pure profit considering all you need is one guy time to program it.

yet another reinforcement of why I went with JB4 tune. until we can tune our ecu vs OBD, the only ecu tune id consider would be eurcharged in Toronto since it is close to me.

Sven’s lawyer, Wee Ghose Yu, says squeal like a pig, OE.
Although phrased in the most bizarre manner possible, look at CFG adding something relevant to a thread!

That's not fair, Mr. J...they did post their "shipping and return policy" with some non-apology nonsense...

On the plus side, it makes it easier to know what tuner to not choose for future purchases.

Exactly I would imagine this will be bumped for a log time to make sure fellow owners don't make the same mistake

Shame on you OE

search is your friend. For several years I’ve offered similar advice to others on this forum regarding allocation of the risk of loss, shipment and destination contracts, and Consumer Protection Acts. You, and your fellow travelers merely sling mud and compare questionable performance statistics.

Sven says, have a nice day.
Stop editing your posts. Law is not strange, YOU are.

The majority of your posts are pictures of polar bears, this is a Mercedes forum. It’s not funny, it’s childish. Especially for someone who says his hands are too shaky to work on a car anymore...

Maybe if act more like an adult and stop saying, “Sven and the boys” in every post, people here will have more respect for you.

All coming from the guy that tried to negotiate with Terry on the JB4 and got denied. Then went and bought a more expensive and less powerful piggyback from Racechip.

The USPS lost my motorcycle ecu for about a month. But it was only a $350 ecu and fortunately in the winter when I wasn't riding much. Although I would never ship my C43 ecu. If I ever do get a tune it's going to be taking my car to the tuner. Not worth the risk to ship it even insured, IMO.

FedEx lost the ECU somewhere in transit to Canada and have not shed any light on what happened to the package or its whereabouts.
We only insure the ECU for shipping at the customer's request, for the value they specify. After seeing FedEx and USPS not back their insurance in the past, this is why we have the following shipping and returns policy:

We, just like you, want the ECU to show up and can't see how it could get lost in transit.....

*** UPDATE ***

Jeremy (owner) of OE Tuning had contacted me last week regarding this situation. He made things right and we now have a positive outcome!!! This shows me that he stands behind his company and the services they offer!!

He would not have helped you if you did not make all of your threads. I don't blame you for *****ing I would have 2

Either way oe reputation is shot around here

Can't undue what has already been done.

To me, that shows that Jeremy realized word spreads on forums and social media real quick. This would affect business so "lets make it right" I'm curious what would have happened if you didn't post this on the forums.

Congrats on getting things resolved to your satisfaction! It would have saved OE and you a lot of trouble if they would have just worked with you from the beginning to resolve the issue, instead of point to their “policy”, especially on this forum. I don’t know how big OE is or anything about their owner, but it’s possible he didn’t know about this issue until it arrived on here, so benefit of the doubt for him. That said, he should demand his employees bring him any issue that is questionable, so he can decide if a resolution is warranted or not...as well as tell his team to never offer up a post like the one in this thread. Customer service really isn’t that hard, folks. Nice work, chynatown.
