The key was not accepting the car in the first place. There stand will be, "I you didn't want the car, why did you take it?"
No hard feelings, but your argument is over. Write a formal complaint about the situating is the best you can do. Maybe something will come of it, but I would guess not.
I wanted a C63 W/PP and refused to take delivery of the non PP car that got delivered. I had my dealer give me a discount for my trouble or I would walk. I guess they felt it was worth keeping my as a MB customer long term, not making money on a one shot deal.

well, with the performance package, it's really really tough to tell the difference. The only visual difference would be the compound brakes and even then it's easy to miss.

I was told the PP brakes looks exactly the same... The Alcantara steering wheel would be the visual difference. My dealer might be wrong however.
