MB bluetec lawsuit in USA

Dave I have not had it done but I have followed the discussions pretty closely and I do not see any consensus that there is a reduction in performance. As the owner of a 120K mile 2012 E350 I am, however, kind of stoked to be getting a zero-mile DPF with trimmings.

Your 2013 ML has the same engine model as my 2015 Sprinter does. Maybe tuned slightly differently.
So after doing AEM 2 years ago, lately I had CEL with exhaust temp sensor code.
Took it to dealer and they performed $5000 repair with no cost to me. Hate to think I would not have the extended warranty on van with 205k miles.
Frankly I think dealer milked the warranty, but who I am to complain?
AEM flash gave me couple of option that I did not have before, like displaying CC speed and holding trip meter when I disconnect battery for storage.
Small things, but they did annoy me in the past.
No performance difference that I could notice and I am very sensitive with those things.

I need to go and check out this Kia you speak of, but anytime I bring my vehicles out people want to stop and talk and offer me money

I had tried the "check the status of my claim" on their website before as well. The only reply I got was a generic "processing in the order they are received". I was especially concerned because I submitted my claim on the 28th of September and got a deficient claim notice in early November. I sent in the documentation that was requested right away and called to make sure that they got it and it was now in the format they wanted and I was told all was good. The months of silence had me a bit worried, so I emailed Shelby. She got back to me really quickly to let me know that my check was going to be sent out before the end of the week last week. So, if you're wondering where you are in the queue that might be a good starting point.
So far I've noticed that the truck was returned to me with a check engine light for swirl motor problems and it will drink down 5 gallons of DEF in only about 2700-3000 miles. I really need to get it back to a dealer so they can deal with the swirl motor code.

Picked up the E350 today with the AEM and the car runs great. For folks in the DC area, I cannot say enough good things about the Penske MB franchise in Tysons Corner Virginia. Ask for Nawfal -- he stayed in touch with me via text and email as the parts came in and the work was done. Huge breath of fresh air after working unsucessfully with an MB dealer in Maryland.

And the icing on the cake.....now understand 10 days ago, I got an email that said all documents were received and my application was in process......

The 1st deadline expired 10 months ago, the extended 4 months ago..
I contacted Shelby, when I had my applications pending and she check my status, replying couple days later.

I submitted before the second deadline because I had to wait to have the AEM installed because Mercedes wouldn't install it sooner because my SUV also had the Brake Booster Recall and it was under a Do Not Drive. So I got it done by the second deadline.They notified me sometime in March that I need to submit additional documentation which I did and got the email on April 4th saying all documentation was received and it was being processed. Then I got this email notification yesterday. I emailed them back explaining all of this and now I wait....although the last email says their decision is final so who knows.

"MBUSA’s direct cash incentive program is not part of the class settlement. I suggest that you contact MBUSA’s Customer Assistance Center at 1-833-841-9362 for questions about the deadline to submit an application as part of the direct cash incentive program."
It doesn't seem like she can help with the newer MB USA incentive.
It was the original class action that she helped with afaik.

AEM was offered had to be done to join the class action by X date. That date has past.
AEM is still being offered, and has to be done to apply for MB USA cash incentive.
Seems like the same thing (Get AEM, then get compensated) but details on how to apply for compensation has changed.

Define "related" ?
I see 3 different things that went, or are going regarding Bluetec
-AEM settlement, who has no expiration date,
-cash settlement, that expired last December, giving the owners up to $3500
-MB USA incentive, still pending giving owners ?????
They all circle around Bluetec, but cash settlement and USA incentive looks like totally different accounts to me.
Let's say you will pay this forum to upgrade your membership and I will pay for the same.
Would that make us related?

I believe the incentive payout that MB is doing directly is to meet the requirement in the consent decree with the EPA that 85% of the cheating BlueTECs are brought in to compliance with the Clean Air Act requirements. The law firm that Shelby is with is only concerned with what was defined in the class action lawsuit settlement. So while they may be related in the sense that they both a result of "alleged" violations of the Clean Air Act, they are separate "buckets of money" as we might call them.
