MB bluetec lawsuit in Canada

It looks like the lawsuit for Canada has arrived. I just received an email regarding the lawsuit. I know there is a similar thread for the US, but I think a seperate one for Canada makes sense since it won't be exactly the same.

The compensation amount seems to be 2925$ if no previous owner makes a claim. 2090$ if a previous owner does make a claim. You'll get the compensation if you go ahead with the AEM. If you don't want to go ahead with the AEM, you'll get between 600$-1700$.
I wonder if the AEM warranty will be the same as in the US. The website doesn't mention which parts are covered and for how long/km the warranty will last. Maybe someone has a list?

Extended Warranty Period. The Extended Modification Warran ty shall be the greater of: (i) 10 years from date of initial sale or 120,000 miles (193,000 kilometers) on the odometer, whichever comes first; or (ii) 4 years or 48,000 miles (77,250 kilometers) from the date of installation of the Field Measure, whichever comes first.
Covered Parts.
The Extended Modification Warranty shall cover the cost of all parts and labour needed to repair the items listed below:

Just got my field measure done last week on my 2012 ML350 Bluetec in Ontario, after the dealership stalled it for a number of months. Although the Ontario dealership did a good job when they installed the Field Measure, it took them 3 days to do it. We purchased our Used car in August 2012 in Texas but brought it into Toronto, Ontario within that same month. It is currently registered in Ontario, however all the warranty work for the first couple of years was done in the U.S. with no problem. Now, when asking about the claim, we are getting the run around from the firm handling the Canadian claim saying that we should collect from the U.S. firm while the U.S. firm is saying to go through the Canadian firm. Has anyone had this experience or know what to do? Any insight would be great. Thanks in advance.
Also, Is anyone aware whether the timing chain is included in the FM warranty as I noticed that it's been louder since the update.

Submit the claim after the installation. Haven't heard anything about the money. Don't know where to ask.
One thing I notice, the exhaust gas is very smelly after the Field Measure installation! Anyone experience the same?

I had the bluetec recall performed 2 days ago for 2009 r320. It drove fine yesterday for 300 km. This morning, I started it up and started driving, and within a few minutes of driving, the car went into limp mode (reduced power mode, would not let me rev past 2100 rpm). No engine lights.
I was quite worried.
I turned the car off and re started, and weirdly enough, it drove normally. I drove it about 25 km so far today, and the limp mode did not re appear. It's a concerning issue, more so because the car did not throw a check engine light, so I am not sure what sent it into limp mode. I am now waiting to see if it goes back into limp mode, then I will take back to the dealership. I can potentially see them saying there is nothing wrong because so far, turning off the car and restarting it did return it back to normal level of power. Perplexed.

Hope Canadians mechanics are better, but each of 4 AEMs I did on my vehicles in USA had some issues with stuff not assembled properly.

I am fan of you by the way, I only registered on the mbworld forum yesterday but for a long time I would read through some of your posts because you are active in the diesel forums and your experience is helpful
So this van is strange. All day yesterday, the limp mode did not return.
I left it parked overnight, and when I drove it to work this morning, it went back into limp mode.
And yet again, I turned off the car and restarted, and it returned back to normal without limp mode.
The observation I made so far is that it enters limp mode in the morning, after being parked outside all night.
Should I wait until it registers enough faults to throw a check engine light? Or should I take it to the dealer tomorrow? I am afraid they will say there is nothing they can do, as it is not throwing any CEL's. However, this issue is definitely related to their bluetec recall which was just completed 3 days ago. This 2009 r320 had probably the most amount of items changed.




"Where there is a limp, there has to be a code".
Read them ASAP as the worst thing that can happen to us is dealing with unknown.
Don't clear them if you planning to do warranty claim.

So they recommended changing the fuel filter if the van goes back into safe mode. I am so skeptical of all this, the problem happened immediately after their bluetec recall. I don't think a fuel filter suddenly started to choke
Anyway, I am out of luck, I will pick up the van from dealer today.




I know it is hard to believe in coincidences, but **** happens.
It's been 2 weeks now since the recall, with intermittent limp mode, especially on cold start in the morning.
CEL finally illuminated yesterday.
Took it back to dealer.
They are telling me the adblue heater is defective. They will replace as part of the bluetec warranty. They have ordered the part but have no ETA on this as part is on back order in Canada and Germany.
I wonder if this adblue heater being defective is what is causing the limp mode, especially as the van only goes into limp mode on cold start first thing in the morning. It is winter in Ontario, Canada where I live, so I am thinking the adblue fluid is too cold or gets frozen overnight, leading to limp mode, I don't know if this reasoning is correct.
I will now await an unknown amount of time to get the adblue heater...
