Mercedes fixes all outstanding problems on a buy back before they sell it at auction. And the car still gets the remainder of the factory warranty. How do I know? I purchased a buy back and saved about 8 grand in the process. Mercedes discloses the problem to the next buyer in a written statement. This statement also says that the problem was fixed. My car stated "transmission concerns". I have had zero problems with my tranny. The dealer reset the adaptive learning at my request before I took delivery of it.
If I buy another Mercedes, I won't hesitate to purchase another buy back. The savings are definately worth the risk to me, especially since it's still under warranty.

My car was discounted 8K off of what pre-owned for the same year with the same options were going for at the time. There's a big difference between 8k off of new MSRP and 8K off of current pre-owned prices.
Also, As I understand it, they'll buy the car back for customer satisfaction purposes even if the car is not a complete lemon.
Let's say MB has a customer that is just a complete pain in the rear. Let's also say that they're not happy with the way their car shifts from 1-2 (common with the 7G) transmission. So they keep bringing it to the dealer time and time again but they're just never satisfied. They complain enough to get MB to purchase the car back but the car was fixed according to MB specs. If that customer stomps his or her feet enough, MB will put them in a new car and sell their current one.
I'm sure that there are some cases where the car is a complete lemon but I have a hard time believing that MB would knowingly re-sell a lemon to the public.
Maybe I was just lucky, I don't know. But I do know that my car has been great. I have had some gremlins, as most of us on this board have, but nothing relating to the reason the car was purchased back.
Yep, it'll be noted in Carfax. But I plan on keeping this car, not trading it in or selling it to anyone.
And on the off chance that I do sell it, obviously I'll get less money for it. But that's ok, because I'm already ahead of the game due to the huge discount I got when I purchased it.
It's a moot point though. I plan on keeping this car until it dies.

buy the way, I was told the 2003 would be crushed after using it as a "training vehicle" The car is listed as a "buyback or lemon" on carfax

...But the only thing I come away from this thread with is "Why would they fix everything they couldn't repeatedly fix for the first guy, and fix it right for the second guy?"

Lastly, the cars MUST be stickered very well also. Many stealers will not tell you of the status on the phone, since they want you to show up to the dealership. However, in California, you must sign a disclosure statement saying that you acknowledge the lemon. You may save $10K today, but good luck EVER selling that car for even half the value. To those that say they will just drive it into the ground I say why not buy a nice one since you plan to keep it. Why commit such a long time to a lemon just for a little (% wise) savings?
Since I was the second owner of the CL, I got dealt w/ the problem child. If you happen to buy a 'Buy Back' and no problems arise, you are very lucky.
