I am considering starting a class action lawsuit regarding my keys

I am not happy with my dealer regarding my key fobs

My E350 Keys are cracking in the plastic buttons and my local MB dealer and MBUSA are refusing to honor the factory warranty on them claiming abuse.

If you have Mercedes Keys/Remotes that the plastic buttons are cracking and Mercedes has denied warranty, let me know if you would be interested in pursuing legal action against MBUSA.

MBUSA does cover membrane cracking under warranty, PM email address and I will send bulletin, present it to SM who should approve replacement.

Thanks for the PDF.. I gave it to my attorney. My keys are clearly warrantable per the document. I dont understand WTF my dealer and MBUSA are claiming.

I don't think it's only because the key cover is cracked. It's the principle of it all. For something as simple as that, they should just take care of it. Imagine something bigger, why even have warranty if you can't even use it.

I think all car sales guys are scumbags by nature. I've seen and dealed with enough of these guys over the years. Once the cars are sold and when little things are broken and needed attention, most of them don't bother to provide you w/ good service anymore since there's no additional money to be made. Problems like this has nothing to do w/ the manufacturer. The sales guys can submit the claims to MBUSA under warranty or good-will, but they choose not to because of no more money to be made.

I have a feeling all this is the result of the litigious attitude exhibited.

There is a 5+ page thread about this "lawsuit" on another forum... This forum would look very amusing if all our problems were presented in the format: "I'm considering a class action lawsuit because..."

Bingo. What good is a warranty if the dealer wont honour it?

The whole point of the "class action suit" comment came from me being told by the dealer that MB has a published document that states do not fix this issue. If a number of people have this problem and cant get them fixed under a warranty then quite frankly I believe they should be sued..

However I have since received a TSB giving me all the info I need to get the Fob replaced under warranty and my attorney will get it taken care of at no cost to me since the dealership is acting like idiots.

I didn't hire an Attorney, I am married to one. So shooting off a letter on some letterhead is not real hard or expensive.

did you try another dealership? seems like some people have been able to warranty it.

I guess if everyone had a free lawyer, they'd be filing suits left and right to get **** done.

MB will tell you to suck it up and pay for a new key......don't blame them...its a wear and tear product...if battery dies or whatever fine they should change that...not cause its cracking....what you going to do next? ***** about the leather cracking cause you sit on it all the time?

First post on this forum, don't bash me too hard.

Seems that there is quite a bit of blow back for someone trying to resolve an issue that should be covered under warranty. Now I don't like the litigious nature of our current culture, especially when people sue for things that should be covered under Darwin's idea of natural selection.

However this is something that is not left to interpretation of subjective opinion. If the warranty says it is covered and MBUSA is refusing to honor it, we should support any person working to force them to honor it. It works in our favor going forward to have these things brought to light and ironed out.

I have had similar, but much more frustrating issues with my 350Z pulling to the right and it was never formally recognized as a manufacturing issue.

Hope you get your FOB fixed under warranty as it should.

my friend got a 2011 C300 and key has changed again with the buttons being a harder plastic. can't find a picture to show you guys but glad they changed it since the old buttons could crack so easily

Buttons cracks because it being push by the nails, I had mine fir two years abd is still looking new. The new redesign key has three seoerare buttons now that can no longer cracked, but it more of a rugged looked compared to the original clean smooth which I love.
