I also filed a report with the EPA. Maybe they can open an investigation too. They already caught MB once and it costs them $59 million.

Clean fuel sender unit & have car in posession
OK guys. Good news. This morning they took out the rear seat to expose the fuel sender unit. It looked as clean as new. I also saw them put on the new tire they promised and I have new floor mats on my "new" 2009 E-350.
To keep the fuel sender from going bad I searched for "No ethanol gas" and got a list of stations that sell it. Be prepared to spend $1+ more per gallon, though.

Yup. Just got home from having the tank replaced in my 06 E350. Same symptoms. Fuel smell after fill-up. Dealer first replaced o-ring. After a week, I filled the tank and still smelled gas. I popped the rear seat and opened the access panel. The well around the unit was full of gas. I took it back and they said the tank was "warped" and that is was a fairly common problem. $2100.00 to replace the tank. Unbelievable! I freaked and they said they would split 50/50. I will be filing a complaint shortly.

One thing that worries me is that MBUSA is arguing is there is not enough complaints to warrant a recall. They claim there are over 300K + W211 vehicles, yet only a handful of complaints. Officially 25 AMG E Classes and 50 E Classes.
If you havent filed yet...please do. It only makes our fight stronger!

so i have a little update for this issue, the NHTSA investigator JUST CALLED ME!!!! woo they're investigating this problem and are on it!!! i gave them the website and the investigator said that he is going to log on and view the thread, so if any of you guys get a phone call from 1-202-366-7021 or similar, PICK UP!!!! thats them calling you to ask questions about this issue. so yea hit that website and file a compliant because this is the only way we're gonna get this issue resolved at the expense of Mercedes.....

The gas odor issue is one of two main reasons for me to sell the car recently. I have filed a complaint a couple months ago. Even though I don't have the car now. I still hope the the NHTSA will make MB pay for this serious safety problem!

Can't the NHTSA investigator subpoena all the paperwork for the gas tank repairs from all the dealers?
I am still filling my car 3/4 only to avoid the gas leak. I wish the NHTSA could use my car undercover and document everything the dealers say about it.

Im not sure why people on this forum seem to think that this problem is only happening to AMG cars... IT ISNT... This tank problem is happening to every w211.... All W211 owners should stand up and be heard a fuel tank is not a moving part and should never fail based off of normal use...

2007 Cls 550
Bought new and have 32000 miles started noticing the smell 6 months ago. When I fill my tank to 3/4 no smell.
I have the fuel sending unit problem as well. I know a Mercedes mechanic who has worked for Mercedes for 23 years and does work on the side. He told me yes it is a problem. He said he would replace it for $440. I am going to go to the dealer with the info i have from this board and see if they refuse to fix it out of warranty no cost. I spoke to the attorney and am going to join the suit

The E320 omission is probably just an oversight. Page five of the court filing states, "The models include the E350, E500, E550, E55 AMG, and E63 AMG." Instead, it probably should have stated something like, "the models include, but are not limited to, [list of models]" to avoid leaving anyone out.
The document elsewhere states that the W211 gasoline-powered vehicles are the subject of the class action. Maybe they should have just stayed with that generic description rather than making a list and inadvertently omitting a model.

I haven't heard of any issues. My 06 E320 CDI has never had any issues and it has 106K miles. When I fill I always top it off and have never had any diesel smell in the car or outside.

And the Absence of a problem doesn't mean that it does exist. I am just saying that on my 7 year old diesel with over a 100k miles the problem has not surfaced. Who knows why, could be that the fuel systems are designed somewhat different or use different seals or that the diesel fuel doesn't have the same chemical reaction with the fuel tank seals.
Have you heard of anyone with an W211 diesel having the problem? I haven't.

I have an 03 Mercedes E320 and it just started leaking under the back seat last week. 88k miles. Spoke to MB there is no open recall. How can I file a complaint with NHTSA? $1500 for a common problem?! Never!
