Just filed my complaint and spoke with a lawyer in relation to the class action suit. He advised me to take the car into Mercedes and have them inspect it. I also was able to get the inspection for free as I have a friend with the same issue who was not charged at another Mercedes dealer. My final question, where is the recall on the transfer case??

Why is the E320 not in the list on the class action site?
They list the following models as being potentially effected. Whilst it doesn't say it is a definitive list, does anyone know why the E320 is not there ? I have seen at least one e320 owner post to this thread.:

Anyone with a fuel leak should be filing an official complaint with NHTSA....
I went through an compiled a list of members names from some of the most active threads and already found 111 people with this issue.

I just fill the NHTSA claim, I have a 2005 E320, I have it repaired at 73000 miles the smell inside of the car was quite bad, the leak was impregnating the seat and was visible also from under the car. I was not willing to have my baby riding in a car that may catch fire!

Moosejaw is right... If you want to ever get reimbursed for your out-of-pocket expenses for fuel leak issues AND want a permanent solution from MBUSA each of us needs to spend a few minutes submitting details on the NHTSA website.
This is a numbers game, and until we can prove this issue is widespread MBUSA will ignore it.....and us.

For those of you who don't know exactly how to file a claim with NHTSA here are the steps you need to follow:
Go to: https://www-odi.nhtsa.dot.gov/ivoq/
In the Box called: Vehicle Complaint select "Begin online form"
Add your VIN
Add your Vehicle (Start typing "Mercedes Benz E55" and the list will offer you options to autocomplete your selection, including the year)
Add the "Incident Date"
Add the "Vehicle Mileage"
Add the "Vehicle Speed at time of incident" (I'd say 0 MPH is appropriate for this issue)
In the "Affected Parts" pulldown menu select: Fuel / Proplusion system
Below that is an area for a 1900-character description of the issue. Please reference the NHTSA Action# PE12001 in this area to help connect all of these complaints.
Then add your name and address in the area at the bottom, verify your data and submit your form.
Once you do that, you will get an official ODI# assigned to your case.
Please send that ODI# to me so I can update our masterlist.

Thanks for putting a master list together Greg. Should really make it easier for people to see exactly how many of these vehicles are affected.
Just imagine how many more owners of these vehicles are out there with this problem not on these forums and that don't know that this is a defect in the design of the system

I'm not going to post a new list until tomorrow (Friday) but I wanted to let you all know that the list is now up to 119 members with a total of 32 official ODI#s filed with NHTSA....
That's only a 27% ratio of reports filed vs. actual issues seen, but it's a good start!
Please help me to get the word out to the members on the list who only have blank data next to their names. I'm sure there are some members who have left the site and aren't likely to ever check back in here, but there are still plenty of active users who can be persuaded to provide data and file with NHTSA to help the cause.

My 2005 E320 has the leaking fuel tank and the Dealer advised no help with the tank since it was over 100k miles. But advised they could fix it with the same tank for approximately 1700.00. I believe I have filed with the NHTSA.

got my car back yesterday for the DS fuel sending unit leaking. Below are the part #s on the invoice

Before finding the details on this forum I had a sending unit gasket replaced twice by a local shop to no avail. After reading this, I brought it to the dealer (RBM in Roswell outside Atlanta) and had it repaired at about $1200 all in. I believe they replaced the sending unit entirely (and thus hoses).
For what it is worth, I sent them information on this documented issue and the service advisor was oblivious to it and ignored it. They ultimately offered to just replace my seat cushion for about $200 and assumed the leak/spill must have already been cured by the gasket replacement. This was upsetting. I compelled them to fill the tank up all the way, after which they reported significant gas pooling/leakage and performed the full repair (charging me $1200). They had no interest in the NHTSA investigation or the class action suit.

Please add me to the list! I just had my smelly leak fixed in August at the dealer. I got a new sending unit and it fixed the problem. I have a 2004 E320 4-Matic. I already reported it to the NTSB, I kept the part and I am about to write a letter to MB. Just have not had the time yet.
I purchased my E new and now it has about 78,000 miles. It only stank after I filled it up all the way and parked it in my garage. This is the first repair that I have to pay for on this car, but technically MB should be paying for this!
I can't understand why the E320 is NOT on the list, it is obvious that most W211s have this issue!
