Offsite Airport Parking - EWR - Oops
I took the car to a MB certified body shop and received an estimate for $2800 in damage. Tom from EZWay called and said that all body shops are crooks and that the work would have to be done at his body shop. When I refused, he said that I would have to sue in order to get the cost of the repair paid for by them. I made a claim with my insurance company.
The insurance company has already looked at the car and gave me a check (less my deductible). They will contact EZWay and if they are successful will send me my deductible.

Can you sue them in small claims court stating that you want the car fixed at a Mercedes certified shop to bring the car back to Mercedes specs and not at some place they found where you have no idea what the quality would be. You should sue them for damage total at Mercedes shop + rental car coverage + depreciation of your car due to the bodywork. I'd give them hell. They damaged your car and it is their responsibility. I bet they have insurance.
Wonder what would have happened if you called the police when you saw your damaged car and handled this situation as if someone hit your car and got the police to provide you with their insurance information... Can someone with some legal background chime in to say what would happen if your valet or parking lot person gives you your car with damage they have caused and you call police to report the "accident" and get their insurance information? This way you don't have to worry about the deductible. Last time someone rear ended me, this is what I did... I got their insurance info and worked directly with their insurance company. It worked great as I was not out of pocket a cent.

I would have done the same thing--just file a claim on your own insurance and let them go about the work of collecting from the responsible party. I've even done this in the past when I just didn't care for the treatment I received from a responsible party's insurance. You're paying your insurance company for their services. Use them!
Chances are the lot owner already has coverage for this type of loss. It sounds like he is just trying to avoid a claim. Guess what? There's going to be a claim as soon as your insurance company comes calling.
I took the easy way out and had my insurance company deal with it. If in the end, I'm stuck with the deductible, I can always sue for that.
As for the depreciation, it will be hard to argue that my 9 year old car with 292,000 miles on it lost value because of this claim. Not impossible, but difficult.
I was very satisfied with my insurance company (High Point/Plymouth Rock) and with the body shop (Caruso's in Plainfield, NJ). Both were professional and responsive.

What would have happened though if you called the police to the lot and reported it as an "accident?" Unless I am mistaken, Police officers can legally work on your behalf to get the insurance information from the offending driver as if someone was neglegent and hit your car.

I did get a call from the employee who damaged my car. He apologized again. I told him that because of his honesty, I would not go after him personally for the deductible, only the company.
The car is scheduled to be repaired next week (August 9th).
