Angry NAV replacements with excess mileage

I will be receiving a NAV replacement car for my 2003 E500. I currently have over 12500 miles on the odometer and the car was picked up in December. The dealer nor Mercedes USA has never expressed any mileage limits to me. How can they leagally enforce a $.48 per mile penalty on mileage over 15,000 prorated. At this mileage charge I may owe $2000 to $5000 at new vehicle delivery depending on my use between then and now. Mercedes customer service has deteriorated worse than their JD Power ratings. Sadly the three-pointed star is not what it used to be.

Have you heard about the mileage charge from your dealer or just on this forum?

I contend that they cannot impose this fee. It was not disclosed when they asked you to order. Actually, it has not been disclosed to any of us to this moment. We have only heard from members who were told when they picked up the new car.
They are not giving anyone a chance to minimize the charge...
$100. for every 200 miles driven is a pretty high price to pay and can't be justified.

Maybe I'm a little conspiracy theorist.. but I would almost bet that it's a fabrication perpertrated by dealers/MBUSA to look like shining armor when word hits about the mileage penalty and then "magicly" waive such fees at delivery... as a "bonus" and a "thank you." My dealer isn't giving ME SQUAT.. and this wouldn't surprise me if other dealers who are "penny pinching" in this fiasco would do the same (to save face so to speak).

Then again.. maybe not. I don't think they can enforce it anyways. I have a patient who's a BIG car guy (he has an M3, Porsche 911 AND BoxsterS, and a Maserati Cambriosa?). Anyways, he's an attorney.. and hopefully I'll see him tomorrow. (He needs his drugs ;-) I"m going to ask him about that.

Was there any mention in the letter that was posted here? I never did get the letter, but I don't recall seeing any mention of mileage. They can't change the rules halfway thru the game. I got my original car in Oct. and just turned it in with a little more than 10K. My salesman never said anything about mileage about for my car or any of his customers. Under normal circumstances I would have had close to 25K on the car in that time frame. I just didn't drive as much as usual this year.

No, I have never received any official word from anyone. I just became informed by this forum. I also do not believe they can legally enforce this without prior written notice on the contract that they made me sign. Is this a ploy by MB USA to create fear and keep Nav replacement owners from racking up miles on their cars that they will be turning in? Possibly so.

Remember, we've only heard this from a couple of people. Most not aware of this limatation/upcharge. It could be a dealers way to negotiate goodwill.

Especially to now start charging for miles.. when probably several hundred E's have ALREADY been replaced. Doesn't make sense to change the rules DURING the game.

I had my E replaced on Monday with over 10,000 miles. I was asked to sign a few forms and that was it. I can't imagine that there's a policy in place imposing a fee for excess miles.
