surging problem 2013 e 350 fourmatic luxury

I took delivery Jan of 13 and started a 4000 mi trip at about 900 mi into ownership. My first experience was maneuvering through Atlanta's rush hour traffic and experiencing the gas peddle not responding to my foot pressure as I was slowly (5 or so mph) rolling and wanted to accelerate to change lanes. I would apply the pressure that normally would achieve the proper boost in speed and no response. I quickly applied a little more, no response. I applied a little more and the car leaps out. I soon realized I could clip the corner of the cars a was attempting to clear as they closed the gap while my car wasn't immediately responding to my foot pressure. This surging would also happen occasionally after backing out of a parking space. I would come to a stop, shift to forward, slightly and evenly pressure the gas pedal and it would leap out. Now here's the catch, it only happens occasionally. The delivering dealer has been sympathetic. They have checked for error codes with no success. They have reset the adaptive transmission's memory twice. They have test driven the reasonable amount of time they could do so. It doesn't act up for them and since it won't they have explained they can't just start to replace parts that might be of suspect, whatever those might be. They have to experience the problem personally to attempt to resolve it. I don't gas and brake with both feet so that is not the reason for the surging. I came from a Lexus ES 350. If I would let the car be driven by a MB tech or service manager for days on end they would experience it sooner or later but I don't want to hand my car over to be someones daily driver til it acts up and I don't think they want to take it under those circumstances as well.. I have put on over 16,000 miles to date. Totally love the car other than this very annoying problem. Any insight or suggestions you may have on this problem would be appreciated. I just see that I placed this in the w211 instead of w212 area. Not knowledgeable on how to transfer to correct area. Is that possible?

Very hard to second guess that type of fault, but I would closely look a pedal sensor--------you say you depress the pedal but you do not accelerate untill all hell breaks out------thats my two loonies!!

I will be waiting with baited breath to learn the service managers reaction and expression when you indicate that some dude on a forum suggested a look at the pedal sensor.

I didn't mean to imply that I would say it was any one Else's suggestion but my own. I also wouldn't tell a Dr I read it on Web MD.

Almost seems like it is an ESP or traction control issue. If you are changing lanes(turning) and gassing it, the ESP is sensing a slip and killing the throttle. My C32 AMG would do this all of the time. Just a thought.

Yes. I inadvertently placed it in the wrong area. I'm trying to learn if I can transfer it to the W212 area or if I have to remove from here (W211) and redo there. Any guidance will be appreciated.

No problem putting it in 211 area as the older cars might have had a similar problem where you might have a limited few in a newer car.

I reached the point with the dealer where they suggested MB customer service as they had done all they could do within the guidelines mandated by MB without factory approval. I contacted MB and once informed of the problem, they approved the dealer going further to diagnose and repair the problem. The service tech installed new software in the transmission control unit and the ME (that was on the work order but I don't know what that stands for) control unit. That was done 10/28/14 at 31,827 and as of today, 12/16/14 and 33,516 the car behaves perfectly. Just wanting to give a follow up and thank the above people for their suggestions.
