This is a weird thing to go by in my personal opinion. I drive my car about 5000 miles annually (will be even less this year), so that means I should be getting my oil changed at 5000 miles versus the 10000. I understand it is whichever comes first but I think I am going to wait it out a bit more this time.

I usually hit 10k miles around the 13-14 month mark so somewhere around there is when I go. My wife's commute just cut in half so I think we'll probably go more in the 14 month mark, which will be about 7,500 miles. Both cars driven daily and I just want to find the right balance of fluid life, miles and time.

Read the Operator's Manual
Whichever comes first per the OM. After the warranty is up, up to you.
If you do not follow MB instructions, MB could deny warranty claim. Probably wouldn't, but do you want to take that chance?
If you can afford an MB, you should be able to afford the required maintenance.

Maybe I am just overly optimistic with MB's view on warranty issues, but it would be a really low blow by MB to void the warranty because I am not spot on with their requirements. What if I put 10,000 miles in a year of stop and go brutally hard miles on the car or put 10,000 miles of easy breezy commuting on it but don't go in until month 13. Either way I would expect them to honor it.
There has to be some slack put in these requirements. I'm not doing it every 18 months or anything crazy. Hell, they couldn't' get me in for 3 weeks one time and that put me over the recommended time limits. They going to penalize me then? My dealer hasn't said anything to me to indicate how I am doing it is problematic and I have asked specifically if going a little over on either requirement was going to be an issue. They said no.
So, no, not concerned at the moment. And for the record - I haven't gone over the miles yet, and have only gone over the time limit by ~1 month and that wasn't even my fault in one of the cases. The other was my wife didn't tell me about it and I noticed it when I took her car out.

My dealer has told me they don't worry about it being 1-2 months over. However, if a claim 'could be' the result of a fluid not being changed within intervals, then you can't count on what some service advisor tells you.

I agree - which is why I said it would be a low blow by MB, and the service advisor not coming to bat for you would be awful as well.

There is a thread in another BMW forum about an owner who was 1000 miles over on one of his oil change and 2000 miles on another. He wanted to certified his car or buy extended warranty, BMW check his maintenance record and demand a $800 service to remove the heads and check for oil sludge before they would sell him the warranty, All warranties are approve by the headquarter, rather if its BMW or Mercedes, and I don't think the SA can even lie about the maintenance mileage since it is all recorded on the computer. I always change my oil about 500 miles early, if one wants to save a few dollars, just use a indy and keep the receipt for your record.

The dealers and SA's don't approve warranty claims IF MB denys them. If you are not maintaining your vehicle to MB standards, MB can deny the warranty claim. Which they might do if it is a $3,000 and up transmission, engine, brake, etc. claim.
There must be 30+ comments in my Operator's and Maintenance Manuals stating that warranty will not be honored if vehicle not maintained to MB standards.
Hopefully they won't, but is it worth taking a chance on it?

I get it guys, I really do. And I have never been over on miles. I always get it done within those specs. It is the time component that I have exceeded by a small amount, and one of them wasn't even my fault.
