Note that the power seat issue was earlier reported resolved for 2023 models. I also watched the video with the MB trainer demo car (below) and it was mentioned that 3rd row seats are also restricted in allocation. That particular 2022 EQB also does not have power seats.
FWIW, our 2023 350 Prestige is scheduled for production next week and as of yesterday it still has the sunroof, power seats, and 3rd row.

Hello guys, let's figure out a way to sign a binding contract with the dealership this week in order to secure the 7500
I just got an updated build sheet for my 2022 EQB 300 and it has the panoramic roof as an added option. No power seats though. We’ll make a decision once the car arrives—hopefully later this month.

Final assembly for all EQBs in the USA is the MB factory in Kecskemét, Hungary. This is also noted on the build sheet for our order.

Personally, I would not want to own a car from a startup OEM where the nearest service/parts is >2000 miles away.

A contract to purchase does not require payment in full prior to delivery. There is an excellent example of a suitable contract to purchase earlier in this thread, and FWIW, my dealer provided a fairly similar document that was parsed by their legal folks. When I spoke with them today they laughed that I was squawking about it before anybody else and now they have completed a couple dozen.
Maybe the IRS would accept a dummy contract and maybe they won't.

FWIW, The new law has replaced the previous $7500 tax credit with two concurrent $3750 rebates based on final assembly location and battery sourcing. Some vehicles will be eligible for one, both, or neither (like the EQB). There are also new limits for personal income and vehicle prices that will eliminate many MB models and customers.
This is why the upcoming MB EQE SUV (assembled in Alabama) will most likely be eligible while the the EQS sedan (made in Germany) is not.
The President is signing the bill today, so the well known $7500 EV tax credit is GONE. We don't have official IRS guidance (yet) on the transition process included with the new law, so now it's wait and see for those of us with documented contracts prior to enactment. But fingers crossed we have the proper documentation and eligibility.
Put down a $1000 deposit on 6/23/22 on an incoming 2022 EQB 300 that has already been built and is just sitting at the port in Baltimore. Based on the sales sheet, I can confirm it does not have power seats and I'm receiving a credit of $700 for this missing feature. Based on everything I'm seeing on paper, there is nothing to indicate an issue with the panoramic sunroof, which was mentioned earlier in this thread. I expect the vehicle to be equipped with the sunroof.
On 7/29/22, I convinced my dealership to provide a signed buyer's guide / purchase order. This PO contained the VIN, final pricing including tax, title, license, etc. and has been signed by the dealership. I felt good about being locked into the tax credit with this documentation.
Earlier today, my dealer sent me the official memo that was posted earlier today. The memo clearly denotes that the EQB loses its tax credit once the bill is signed into law, which happened earlier today. The memo is completely silent in regards to the transition rule, which of course is leaving me quite uneasy. I asked my dealership to follow up on the memo (there is an email address for them to contact with questions) and specifically ask about the transition rule. I'll post a follow up if I receive a response.
I had resigned myself to accepting the lack of power seats, but a big part of that was knowing I could apply the tax credit to this year's returns. Furthermore, I didn't realize until I read this thread the MY23 models would all have power seats. So now I'm faced with a tough decision where I'm not 100% sure I'll actually get the tax credit, and without it I would certainly prefer to just wait it out and order a fully customized MY23 model.
