unbelievable...dealer wrecks my car

Last week I went by to talk to the service manager. I explained to him that I spent a few thousand extra when I bought the car to get one without a crash history, I even waited 5 months to find one then I had to order it from New Mexico!!!!!! I explained to him that because of this car crash I was bound to lose money when I wanted to sell it. I told him that I thought giving me an extended warranty would help me not lose too much money when trying to resell the car. Honestly I was just fishing, it would be really nice to get it, I think it would be fair, but I dont think its asking for too much. After I asked he turned into a complete douche bag, **** rag, **** sucking mother ******. He responded with "but it could have happened to you", even though I imagined jumping over the table, strangling him with his tie and stabbing him to death with his house key I kept my cool and responded by simply saying "yes, but it didnt". He said he'd let me know. I went back today and he said that MB doesnt feel like they were at fault and they shouldnt have to compensate for anything. He said it like such a douche too, like the car crash was my fault. I've never wanted to slap someone so hard before.
Is thee anything I can do? I really dont want to come out of this a loser for something that I had nothing to do with. What do you guys think? Personally I think hes treating me like s*** because Im young and hes not taking me seriously.

You need to contact MB USA and talk to them, as well as get a hold of the regional manager. They have the authority (and very often exercise it) to call the dealership and lay down the law.
You have substantial damage and the excuse they are giving you is unacceptable. It's high time for MB USA to become involved.
If all that fails (which I doubt it), time to start proceedings in small claims court.

You might remind him that he, as a dealer, would pay less on trade for a car with significant repair history. Tell him what you have been told so far is not acceptable.
If he balks, you can tell him that you wil refer this matter to your attorney and suspect that the claim you'll win in court will be much higher than what you are asking for.

Have all your information in front of you - they'll most likely have a record of you and your car already. Have repair quotes available for faxing/e-mailing.
Sell yourself: Explain the situation, calmly bad-mouth the dealership, name names, and make sure you tell the representative exactly the excuse they gave you (i.e. "it could have been you"). Also tell the rep what their proposed plan is in terms of renumeration.
Don't stop with talking to the rep. on the phone. Ask the rep. for a direct phone number / contact for the regional manager.
If you do it right and be persistent, I guarantee that you will be getting a call from the dealership with a more-than-reasonable offer.

don't mess with MBUSA. just file suit with the dealer. in CA, you will be entitled to repair of damages, loss of use while vehicle is being repaired and dimunition in value of the formerly damaged car. a lawyer friend of mine had a valet damage his new porsche and they settled on a rather substantial 5 figure sum.

W211 Beast - At least those of us in SoCal now know what dealer to avoid. Seeing how they have reacted to a situation they partially caused is enough for me never to darken their doorstep. You'd think they would at least be trying to work with you, even though technically it was not their fault, but the car was in their posession. If you end up suing them and the driver of the car that caused the accident, there is no way they can claim your now damaged car is worth the same as a similar undamaged model. You may want to get in touch with an auto broker who would be willing to give you a written statement to that fact and give a value for each car - damaged vs undamaged. Did you get a pic of the damage? Also, your car is now disqualified from certification (CPO) eligibility, if I understand the program correctly.

I got an FX35 for a rental, My bro is driving it since we can put unlimited miles on it and work is 30 miles away from him. I'm driving his CLS500 for now. Honestly I want my car back, now. But on the other hand I never want to drive it again. I feel like my wife cheated on me and now she's trying to slowly get back into bed. I really dont know what I'm gonna do.

I also want it to be known that before my E-class I used to drive my parents work car, which was a Chevy Tahoe, and they have NEVER disrespected me the way that these **** munchers have.

I think I misunderstood when you said that the dealership is trying to make things right. They basically spat in my face then basically told me to go F myself. And the member from Oahu, this was originally his thread before I unrightfully stole it. Sorry about that BTW.

Lawyer up right now. Any E with 6K in body work has just lost 2-3 times that in resale value at a minimum. Think about it. Would you buy another one that had been wrecked at any price?? And you will not get the old "starmarked" or now CPO status on anything that has been wrecked. F*** them. Time to post this up on dealer rater.

I'm forcing my lawyer to take on my case. He's not a car guy so he thinks I'm "fishing" and it's a long shot, but I told him that he has no choice (he's my cousin). I'm want to take my car to Beverly Hills Mercedes and have it inspected for trade in, I'll also ask for a trade in price if it was never crashed. I'll have it in writing from them that they Fd me.
My question for everyone- is it ok if I have the body shop fix my car before I settle all of this? They got the parts in today but I told them not to start yet just incase.

Of course the dealer might notice my car when giving me trade in value, so they might either screw me by giving me 2 close figures or they might not be accomodating at all. I'll go to other dealerships and auto brokers. Anyone in Los Angeles have an auto broker that they reccommend?
