Keep in mind... the other driver was at fault, damaged your property, and is liable for that damage if you don't live in one of the crazy "no-fault" states. His insurance is there to aid in alleviating the financial burden that might arise, but it doesn't change the fact that he is personally liable for your damaged property. How it gets fixed/paid-for to make you whole is his problem; not yours. If you do retain counsel, you might be (probably would be) advised to sue - you would be suing him; he in turn might sue his insurance company for insufficiently covering your claim.
You should mention to your insurance broker that you feel she has an inherent conflict of interest in the situation, and she appears to be acting in "bad faith" to get you the best possible resolution to this unfortunate situation. Mention that if things don't improve and your doubts persist, you will likely contact your state insurance commissioner's office and the NAIC to escalate the issue. See if that puts a little pep in her step.

I know this may sound odd, but if they settle your claim and you do not get the car back, I collect window stickers from unique cars and would pay you for that one. Just something to keep in mind.

Thanks for the advice C32. I think you are right about the conflict of interest and I may try using this. I could use some help from my insurance company/agent but I have been trying to deal with the other drivers' company.
I know I can retain counsel and file suit against the at fault party but I feel that it may not be worth it after paying the fees. If I can't get a better settlement that what the insurance initially offered I will probably go that route.

My ordeal finally came to an end. The E55 went to salvage but I removed the mod parts. I'm still sad about it but change is inevitable in life. I picked this up yesterday but I haven't had time to give it a good cleaning yet. It has a little over a year remaining on a factory warranty.

I have seen tons of awesome pics online of these beasts. That is by far the worst one yet. R.I.P. Beast ........... One good thing is it makes my car that much more rare.

I haven't driven it daily yet but I think it is quite different. The E55 was much more responsive from a stop. I had the SprintBooster with the other mods and the power was instantaneous and I liked it that way. The CL is a lot slower from the start. It is also smoother and quieter.
My mechanic thinks the SprintBooster would work on the CL but with the turbos I'm not sure if it would make much difference. The CL interior is much nicer than the E and once the CL gets rolling it will really go. I think my E was faster but with a tune the CL would probably do well against the E.
This CL looks brand new inside and out and it drives like a new car. It is crazy that you can buy a $185000 car in this condition(with remaining factory warranty) for less than $50K.

The insurance ended up giving me a little over $32K plus tax which brought it to $35K. The Chrysler warranty refunded $2200. I never used the warranty.
My wife wanted to know why the E55 was so much cheaper than the CL65. I really couldn't answer that. I guess all the 65s were made in low numbers so they cost more. I've had several people complement the 65 in the two days I've had it. Just every now and then did anyone go out of their way to complement the 55.

The CL is definitely more "rare", but the W211 has a more timeless and modern look IMO. It makes sense as the CL introduced that design language with the W220, and the E-Class was the ultimate refinement of said language, as E's usually are.
CL65 is a sick beast anyway, congrats and glad to hear that it more or less worked out.

Its a 2005 and had 39K plus miles. This was my second try, the first car I was looking to buy failed the prepurchase inspection. This one just popped up on ebay about a week ago. I drove a rental car to Atlanta and picked it up at the Mercedes dealership(they did the prepurchase inspection).
Even though their are several of the CL65s for sale currently it is not easy to find what you want. I specifically wanted Parktronic, Satellite radio, and Keyless Go. This one also came with a phone but my mechanic said I would have to change out the puck to use it with my Iphone.
I was also looking for one with no paintwork and an extended warranty if possible. I felt really lucky to find this one. At first I was looking for another E55 but never found one with all the options I had on my first one. I loved all the options on my E and would have missed anything left off. I already miss not having the dynamic seats on the CL, but the soft close doors help to make up for it.
