Well this morning on my way to work, i was minding my own business on I95 and a 18 wheeler swerved into my lane. I was minding my own business and bam this truck comes out of nowhere and im looking at his side door in my face.
I pull over and he pulls over. He gets out he apologizes and admits fault. I call the FLorida Highway Patrol. Actually called them twice. It took 90 minutes to respond.

Cop shows up and asks me my story and gets the other guys story. Cop tells me that he said I ran into him. No Witnesses. So i'm responsible for my own damages. Theres no way for the state trooper to determine fault.

So the kicker is I have the blackvue dashcam installed. Its been acting and i had to reformat the SD card. I also had to download the newest software which kept on stopping half way. So it didnt save me. I am really sore.

Good thing i didnt bring the rx7 today like i wanted to. Its was cold out 72*

Damn, that sucks, especially if he changed his story. You should have pointed to your dashcam and asked him if he'd like to change his story.

Can't determine fault? Really? The trooper can't really believe that you changed lanes into a class 8 semi truck on your left - the truck is right there, filling your entire view. As opposed to you on the right hand side of the truck and him moving into you.

Of course, with people texting and whatnot, they probably do drive into semi trucks on a semi-regular basis.

Did you get the truck drivers' employer or insurer information? Even if you can't get compensated for your loss, maybe a call can help get a dangerous driver off the road. If he loses his insurance coverage, he can't drive.

man, sorry to hear that. Not sure you would have thought at the time, but pull out your smart phone and hit the video record to record the admission by the other driver that it was his fault. End of the day, car can be replaced.

that fricken sucks! i hate 99% of truckers! i drive from nashville (where i work) back to florida (where im from) all the time and i see them nearly running people off the road all the time, cutting in front people last minute because they dont want to be slowed down by the slower semi in front of them, only then to take 5 minutes to pass the other semi going up hill

I agree with above post. Don't give up or just pushed around by these insurance companies. Also don't forget to claim diminished value if you keep the car.

Not siding with either but you happened to be in his blind spot when the incident happened, if you came up fast on the truck he might have looked then well you know the outcome. Coming back from Alabama last year had a semi truck and trailer come off the ramp onto the highway cross 3 lanes of open road and if I had not jammed on the brakes on the E he would have muscled me into the median, no other cars around and still daylight, so I know how you feel. No fault just give your statement to your insurance with his admission of guilt and let them go from there. Maybe they will check to see if he was on a cell phone, kind of put it in their (insurance company) ear Just be glad you were not injured or tossed into the ditch or guard rail.

That really sux bro, hate seeing anybody get their pride n' joy wrecked.. PS similar thing happened to me in past mint 69' Ford Bronco, guy ran a stop sign exiting frwy. I had to lock up brakes from 45mph zone to try to avoid collision, not a chance clipped his car as he ran the stop sign etc.. Everybody was ok & I said "Why did you run the stop sign?" he instantly replied "I'm so sorry man, I saw you @ the last minute & thought I could make it"

Pigster gets there & his story magically changes into "He stopped @ sign & l came out of no where & hit'em yak yak" I learned a painful lesson that day and thought up a foolproof way to capture these fukurs. Everybody carries smart phn in their hands these days, so next time this occurs put phn on video record, hold it up right in ur palm like ur just holding it & slightly angle vid/cam up towards them & record entire event before story changes then BAM! Undeniable proof!

That's exactly what I would have done. You could have told the cop he was lying and that you had a way to prove he was lying. Get the trooper to show him that you had a dash camera and ask the driver if he wanted a last chance to change his story. I guarantee he would have told the truth to the trooper.
