Does the brake pad stick to the drum? I never use it on level ground. Could be cold temps, rain or moisture freezing over.
I sometimes get the warning to release the brake even though it's not set. I pull on the handle which cancels the message. That's only on really cold days.

it never feels like it is sticking, but im not really going fast because the warning goes off, and i stop and re pull the lever or have to pull it back with foot/hand
is it cold, its southern cali, so 50-60's cold, not ice cold

I've had this happen to me as well, totally random. Once when it was really cold (I'm talking below-zero cold) the brake physically stuck and I couldn't move the car even after pulling the lever. A few more tries and it unstuck.

I don't have this problem, but every few times in the car the BRAKE light is on when I start up (and I haven't used the eBRAKE). I pull the ebrake release and the light goes off (no pedal movement). Assume a sensor in the pedal mechanism is wonky, but I haven't bothered to look since it isn't a big deal.

I that no the problem is that the spring that forces the brake lever back is too weak. I’ve noticed that it doesn’t have enough force to fully release sometimes, especially if the E brake peddle wasn’t fully depressed.

I've got a 2012 E63 and this happens whenever winter comes around. We get down to about -10C on the worst mornings here and the park brake ALWAYS sticks. Have to give it a firm tug for the brake to come loose. (keep your minds out of the gutter). But as soon as the weather is warmer, no dramas.

I had the same problem. Take it back to the dealer — it's not a friction issue, i.e. "lube" isn't going to help it. They need to replace the assembly, tighten the cable, etc.

Im not sure if this is a problem, but if I’m on a slight hill and if I have the car in reverse then depress the e brake firmly ,then put it in Park ,I let go of the foot brake my car moves or rolls slightly, at this point the car should be locked in place and it seems like the e brake holds but I do get this movement does anyone else have this ?

Mine (2014, 56k miles) does the exact same thing,.. to including the rollback which, tells me that the Parking brake is not functioning. None of my other cars do it. On my others, you can feel the car just kind of rise up in the rear as gravity works to try and pull it down against the brake. You can feel the E63 just roll back to rest on the shift pawl. Don't think it would harm anything as I have parked, without using the parking brake for decades without issue.

Same here on the rollback. Like you, th stealer said it’s working as designed. Whatever.
I’m with sjb - suspect the return spring on the interior grab handle is weak / broken.
Semi-OT: I think my parking brake makes squeaking noises. Weird, huh?! Let me describe it. When I park, I religiously put on the parking brake. Sometimes when I get out of the car and walk away, I hear creaking and squeaking noises like the coil springs on my shocks are going. I half think it’s the parking brake assembly instead, but need to untrain my brain to not put on the parking brake every time so I can hear if the noise is gone. Make sense?

I used to have the rollback and it was so annoying like...why do I bother applying the parking brake when it rolls back to the point where the tranny engages Park.
Recently though, i swapped out my rear discs. While I was in there, I adjusted my brake shoes. Now...when I press down on the parking brake, it doesn't do the rollback thing and life is good again.
Hope this helps.

The funny thing is if I engage the parking brake I always get a little roll back like it is catching on the parking pawl but when I go to release the parking brake and put it in drive I don’t get the stress clunk. also if I put it in drive while the parking brake it engaged the brake seems to be working fine it’s locked, so everything seems to be working fine but I still get this roll back

Try this on the spring and cables. The people who install garage doors use this on the springs so they don't stick. Worked for me
