2001 c320 - 2002 ml55 - 2011 c300 - 2014 slk350 - 2015 cla45
rear ended x2.. bad month...
so earlier this month i got rear ended in my w124....

on the morning of april 3 i finally dropped it off at the body shop for repairs (approx 3 wk wait for cars to be fixed at this shop)
that afternoon i mad another visit to that same shop.. this time dropping off my w203....
so today i get a call from this guys insurance adjuster... 48 hours after the accident... and he tells me that he will not be able to appraise the car until monday at the earliest....
and he also tells me that his insurance company has had problems in repair agreement cost in the past.... and that i may have to pay out of MY OWN POCKET for the repairs......
now.. i think thats BS....
#1... do you guys think i should just file a claim with my own insurance to get the car fixed?
#2.. if i do file a claim with my own insurance will my rates go up... even if i am not at fault?

I say call on him and his "insurance company." Idiots like these need to learn to drive, and I'm talking about both idiots that hit both your MB's.
But to answer question #2...your rates will go up...so that kind of also answers question #1, which is no.
Agh, just hate to see things like this happen.

If I were you I would not ask my insurance to pay cos this accident is always at the other party's fault. Dont buy his BS.

tell him you will sue his *** for the repair if his insurance doesn't come through. either way you should not pay for both damage.
everytime I hear someone got rear ended I get pissed because the person who rear ended my 2000 328Ci simply ran away in the open lane. It was at night and in minor traffic, so I couldn't even tell who hit me.

Don't discuss it with the other party. Your best move at this point is to contact your insurance company with all the information that you have about the accident. It is your insurance company's job to recover the loss for you. In other words, if they need to sue the other dude, or insurance company, they have people that will do that.
You will likely need to be prepared to pay your deductable until your company can prove that you weren't at fault. That said, if he doesn't seem like he's paying anyway, you'd be at this step anyway.
Call your insurance company and get it taken care of.

calling up your insurance is not a bad idea actually - say that you get rear ended, and it's their fault, I think that the insurance company dont "up" your rates... at least not here...
They up your rates only if it's your fault... check with the insurance company about that... I only know that this applies to my insurance company...
Also, even if you bring it into the claim centre where they examine your car, you DON'T have to do it with them... having them assess the hit, the price and whatnot, and you can ask them all the questions you have... such as premium going up or whatever.

they said i would have to pay my 250 deductible.... but then they would recover it from the other parties insurance company...
he also said that it would NOT increase my insurance monthlys....
so i went ahead and filed a claim with my own insurance...
so if i have problems with the insurance of the guy who hit me and they claim that they will not pay the total repair cost...
then i will just go through my own insurance..

Fault has nothing to do with it.....ALWAYS go through your own insurance company. That's what you pay them for. And don't let them have you doing their work like contacting the other insurance company or the person involved in the accident.

you insurance should raise since it was not your fault.
you should also go see some doctors and get some money back from that as well

If you were not at fault (ie someone piled into you), you should NEVER have to pay for the repairs! Can you take it to another shop?

but...the other driver hit you. Their insurance is obligated to pay your claim in full (in most states). The adjusters are worms - they'll always try to get you to agree to less - then they lock you in on a verbal contract clause.
Get an independant estimate from a dealer recommended body shop.
Meet with them on Monday, let the adjuster talk - if what he estimates is dramatically different than the other shop (and it will be), advise him of the difference and inform him of your intent to sue the insurance company AND the client. He'll probably try to negotiate, and eventually back down and give you what you want.
