I've been getting that same advice from several unhappy HPS owners as well. One of the dangerous parts of the HPS kit is the intercooler. In my opinion, the first incident of the cracked intercooler on Linh's car was the real cause of the blown motor because the water got into the engine and caused the damage. Now I am hearing that another car blew his AMG 55 motor because of the intercooler failure. I've also been given advice to check my coolant level in the SC intercooler. If it is low then I may have a leak which would eventually start damaging my engine. I think I'll check it first thing tomorrow morning.

I just spent over $250K remodeling and expanding my house by 1,500 sft . That's why I am waiting until I get my bonus before dumping this crap kit and replacing with either a Kleemann or just selling the car and waiting for the C63 or paying a little more for the CLK 63 although I like having 4 doors and the manuverability of a smaller body.

I'm in the same boat as you. I was very excited about the engine swap. I found the person has that done it before on his personal cars through Jesse but the plan was spoiled when the junk guy said that he can't except my engine as trade-in because he can't sell an engine from a car that's not totaled due to DMV regulation/policy.

Final Proof that HPS is a fraud!
After getting only 320rwhp at Advanced Motorsports in Irvine a month ago. I decided to get a final one at EVOSPORT to find out what my AFR was running. Although the AFR looks decent it still lacks any power. My Flecher Jones dealer wiped out Jessie's (SpeedInnovation) chip tuning but it is still a far cry from the bogus 414rwp that HPS sent me. I still need to check the SC coolant level during my lunch hour to see if it leaked into intake manifold like the other guy recently reported on this forum.

This dyno was done with all the airboxes on and no dyno mode in order to simulate real driving conditions. The temperature was in the 90's and an SAE 5correction factor was applied. I used Costco 91 Octane gas. Bob also advised me not to Reset the ECU even though I drive in congested traffic everyday since it would put the car in neutral mode instead of aggressive.

Very dissapointing results once again. This is my last and final dyno. This absolutely proves that HPS was lying about their claims about a 150hp gain with their Gen II kits.

at this point, i didn't think there was any dispute that HPS lied to you and that you got royally screwed. it's been that way for some time now. the question is, what are you planning on doing about it? what's the point of confirming further that you got screwed unless you use that information to hire an attorney, file a complaint, and start bringing the pain. you're wasting all that money on dynos when you could be paying for an attorney. a quick search on lexisnexis tells me that HPS has assets, assets which could become yours if you're willing to go for it.

ok well at least you're doing something. just remember that smalls claims are limited to dispute amounts up to $7500 so that's the max you could possibly receive.

also, whatever you do, don't consent to a judge pro tem, insist on a real judge. judge pro tems are just lawyers that temporarly act as judges.

Nice tip! Thanks. I may still organize a class action law suit and hire a nationally renowned automotive fraud attorney if they would be willing to take the case on a pro-bono or contingency basis.

Ummm . . . this is probably bad advice.

I have been a small claims court judge pro tem (volunteer, unpaid, like all small claims judge pro tems) for about 4 years. Contrary to popular belief that all attorneys are pure hedonistic scumsuckers, there are some of us who actually feel some sense of human compassion and duty to the world, and act upon same.

We are "real judges". . . we just happen to be "real judges" who volunteer our time to try to help people resolve their small dollar disputes without spending tens of thousands of $$$$ on attorneys and years of their lives disputing a relatively small amount of money.

BTW. . . If you refuse to stipulate to a judge pro-tem in California (which you have the right to do), your case goes to a "paid judge" (usually a commisioner). Typically, the commissioners, many of whom also have little automotive knowledge, are already burdened with a bunch of traffic infractions and other matters, and you can rest assured that they are just "thrilled" to see you reject the services of the pro-tem judge. If you think you are going to, via rejection of the pro tem judge, obtain more patient and intelligent judicial analysis of your dispute, you may be in for a bit of a shock.

Let me give you a suggestion. . . use small claims court, and use the assigned judge pro tem (unless you happen to know that the particular pro tem is an idiot). However, you need to consider the fact that the average small claims trial lasts less than 1/2 hour, and that the pro tem typically has little opportunity to listen to detailed testimony about the issues in dispute. As such, you need to get your message to the pro tem in the most expeditious and effective manner possible. You need to prepare (or have an attorney prepare) a kick-**** written brief, with all exhibits carefully tabbed, for the pro-tem to read, so that he can get himself painlessly and quickly up to speed on the technical issues involved.
