I Got A Ticket... Need Advice!
Hi everyone. Today I was handed my first ticket in the C63 -Ive had it for 7 months now. Anyways The weather is nice here in Waterloo and I was out driving in S+ and in SPORT, on relatively bald snow tires. As I accelerated off the light I got a bit of tire squeal (like 1 second if that). I didn't go past the speed limit. The next thing I know from 5 cars back there is a police car with his lights on and he pulls me over. He told me I was 'Stunt Driving' which is a really bad offence, as well that I was easily '50km/h over the speed limit' which impounds the car. (There was no way I was.. Ever!) I would've been over 100km/h which I definitely wasn't, and he didn't have me on radar or laser since he had to weave around cars to get behind me. I wasn't speeding at all since I wanted people to see me in the car lol. I tried to explain to him humbly that I mistakenly had the traction off and Im on used tires. I came back and issued me a $110 ticket for 'Unnecessary Noise' and told me my option. He told me to keep my driving to the track, which I told him I do, and it would never happen again. He was shocked I owned this type of car. Should I take the ticket and just pay it or go to a hearing with the judge and try to explain that I had no intention on creating the noise? Is there an acceptable level for noise such as a decibel reading? Has anyone had any experience with these types of tickets? Does it affect my insurance?

Who said I was crying haha. Never even shed a tear. I will probably end up paying it but here in Ontario we can meet with the prosecution and possibly get it thrown out. I was more interested in whether these tickets routinely get thrown out at that stage, and what affect it has on my insurance. Thanks for your opinion but it was less than helpful.

Not all UAE people are a royal family. Also the police over here aren't dumb to leave you just for saying you're from the XXXX family. First of all they'll ask for the driving license and they'll figure out that you're not and you're just lying !

Next time dont try to impress a bunch of guys with our "engine noise".

NEVER "just pay a ticket" IMO. Examine all your options first. Do you have the right to "Trial by Declaration?" If so, go that route first. I have beaten my last two tickets in a TBD. One was for speeding on the 405, one for failure to come to a complete stop in OC. I was once ticketed on the backside (bottom) of a mountain on the I5 in S. Oregon at 1:00am...no traffic except for a few trucks, a beautiful clear night and the p***k LEO was waiting at the bottom of a steep downgrade. That ticket for $375 was for doing 92mph in a 65mph zone. I read the fine print and it offered the option of posting bond (the cost of the ticket) with facts...essentially pleading guilty with mitigating circumstances (my non-legal paraphrase). A few months later I received a check back for $187.50 from the Courthouse. Was it worth a half hour of thought and effort - you bet. You may receive an insurance surcharge for three years...that alone would pay for a lawyer.

From reading ur story, you got away with luck my friend.. You should have kiss the officer for going from "stunt driving" to "unnecessary noise". U should just pay it.. But since it's a traffic act violation, you will lose 2 points.. I think! U can always fight it to bring it down to city by-law offence (no point, but still have to pay the ticket). i would put it through the courts, and see what happen, theres always a good chance that the cop won't show, in that case the will automaticly throw the case...and if he does show you can talk to the crown and plea to a smaller offence...or you can argue your case.... he can't prove that you were speeding, where did the unnecessary noise come from??? exhaust....factory...you can always argue with them, but till then it will take more than 1 year

I would weigh it against the opportunity cost...if you aren't busy with things that can make you the cost of the ticket plus possible insurance hike, then id fight it. why not?

Thanks for all the opinions everyone! Im going to end up brining it to court and trying to get the prosecutor to throw it out. Worst case scenario I end up paying the ticket at a later conviction date (usually 6-8 month from now). There is no points with this ticket since it is a minor offence, but it does show on your driving record, which can affect your insurance so I might as well try to get rid of it. I honestly can't think of a reason to 'suck it up and pay it,' now that I know it can affect insurance. Hopefully this will be my first, last, and only ticket of the year -We'll see. My last ticket in the past 3 years was for 15km/h over in June 2010 so its not like I have major convictions in the last few years that this will accompany.
ps. This is just the kind of ticket this car warrants lol (I don't think I would've gotten this in a car with less torque to the rears)

Never pay for a ticket my friend without going to court. It won't go to court until next year anyway. Most times the officer won't even show. That ticket is so easy to beat in court that you'll laugh. I live in Toronto and with that new speeding law from the idiot kids racing in and out of traffic it makes it hard to even get spirited with your vehicle anymore. Not to say what you were doing was right or wrong, just saying try your hands in court. What can it hurt....and if you do get convicted you only have it on your record for a year.

just pay the ticket. Don't think of it as paying $100, think of it as paying $100 for not wasting ur time fighting it in court. When i got my 7 tickets earlier this year for reckless driving, speeding, and other juvenile activities... i WISHED i could just pay it off and go about my day, but they wanted me in court.
bottom line is you weren't practicing safe driving and are penalized for it. As much as i would hate hearing that told to me, its the truth

You're lucky he didn't give you a ticket for "Stunting" Would have impounded your car.
Try speaking with the justice of peace and see what they can do.
Tell them you're a student and have lots of student fees, books to buy etc etc.... Hopefully he doesn't notice you drive a C63 AMG hahahaha.
Try to get out of it... Any driving offense that you're convicted with in Ontario will drive your insurance premium up.
On a side note.. My 993 was running straight pipes... and could be heard more then 1 hwy exit away.... Cops pulled me over all the time for excessive noise. I had the dealer write a letter stating my exhaust was a stock factory GT "Sport package" exhaust hahahaha. Cops hated that letter and always let me go.

If your car is as it was from the factory, ie..standard/unmodified exhaust system, then I would most definitely defend it. On the other hand, if it is modified, & may therefore be over the limit, simply pay the fine.
