URGENT: NHTSA Opens investigation into fuel leaks on the W211 E Class

I may have this issue on my '05 CDI (aquired 2 months ago, 85k)... I thought my jug of Diesel Kleen leaked and that was the smell I've been experiencing, which may still be the case; I may pull the rear seat and look for leakage at the sender.
But, why in some cases, is the entire fuel tank being replaced? Sorry if I missed it, I didn't read through the entire thread. I understand the sender at the top of the tank (accessed under the rear seat) can develop cracks and leak when the tank is full.
Seems like a pretty easy fix if dropping/replacing the tank is not involved. How much does this sending unit cost? What else, if anything, is involved with the fix?

That's exactly the same reason we sold our 2003 E500 and replaced it with a 2012 MDX in 2012. The dealer in VA offered 8K discount and gave us 9.3K for the E. We will never even consider buying another MB!

I've got an 05' E320 and I have this issue as well. If I fill it completely my car smells like gas for a day or so after. Filling it slowly and not all the way up seems to help, but is still not acceptable. Hope this eventually gets addressed. Will fill complaint today with NHTSA.

I'll be taking my 2007 E350 PZEV to the dealer today. Let's see what BS they feed me. So sick of the gas smell in my garage. Cannot be good for my three kids to breath. If they don't fix this PZEV for free, this will be my last mercedes ever! I have less than 150,000 miles, this should be covered under warranty......! To be continued........

Good Luck I hope your dealership is not a corrupt as ours.
My wifes 2007 CLK 550 only had 7000 miles.. It was pure hell dealing with these Idiots between the dealer Fletcher Jones Motorcars and Mercedes Benz Corporate. We will never buy another Mercedes EVER>. All they care about are PROFITS> They should have recalled these vehicles years ago and not put their customers through this BS

Quick update, day two with my car (2007 E350 PZEV) at dealer. Just got a call, dealer confirmed fuel pump leak. Now they're waiting to hear back on the PZEV warranty from someone internal at MB. To be continued......

warranty issues
Here is the way it went down for us..
Dealer confirmed the problem told us they would contact Mercedes Corp about any potential Warranty.
2 days later Came back and told us Mercedes would authorized to pay 50% of the parts and we would have to dish out the balance.
Also told us to contact Mercedes directly if we were not happy with the terms.
Contacted Mercedes Corp.
Mercedes case manager contacted us 2 days later and said Mercedes would take care of the parts 100% but would not authorize any labor to be paid.
And after almost a week of calls and stress. That is where it ended.
I hope they cover it under the PZEV warranty.
I cant wait to file my small claims court case against these Idiots

Day four: I'm being told by the dealership they're still waiting to hear back from MBUSA. Four days and I still have no clue if they'll honor their PZEV warranty. I guess I'm having troubles understanding the issue. The PZEV 15year/150,000 mile warranty is in their own documentation. I even provided a link to their warranty and told them the page number. I also sent them a link to the California drive clean website (http://www.driveclean.ca.gov) which spells out the following:
"Vehicles that have a Smog Rating of 9 (also known as “PZEV” or “AT PZEV”) in California come with a 15 year/150,000 mile warranty on the emissions system. Auto manufacturers are required by the California Air Resources Board to offer this warranty in order to guarantee that these vehicles will be as clean in 15 years as they were the day they were purchased."
I bought my first MB from this dealer, I've had both of my MB's serviced exclusively by this dealer! And yet, I'm still getting the runaround. Tell you what, if they don't do the right thing, this will be my last MB ever....!

For me it is not about the cost of the repairs but fact that the scumbags at Mercedes Benz have ignored this issue for sereval years..how many of their customers need to walk out to a garage filled with the smell of raw gasoline leaking from a car driven by their loved ones.. Shame on them for putting their customers in danger.

Wanna know the cherry on top of this whole thing. I have three kids 12 years and under. In fact, my baby seat was in my car when I brought it in for the fuel leak. My two year old sits directly above the leaking fuel pump. My service advisor actually carried my baby seat for me. Don't get me wrong, my service advisor is great. I know it's not his call to make. In my emails I even told them I have 3 kids. So they know darn well I have a cancer causing, flammable fuel leak directly under where my 3 kids sit. MB does not look like it will be in my future much longer. It kind of sucks, I like my E350 a lot. Time to start my car buying research.

According to Mercedes Corporate It is the final decision of your Dealership to allow for a Goodwill Warranty. While the dealership may state they are waiting to hear back from Corporate, the ball is in their court. Ultimately you will see if the dealer cares about your future business by their attitude.

Complaint filed
My 2004 E55 developed the same issue recently, heavy fuel smell inside and outside the car after filling all the way with gas. An independent repair shop confirmed the tank is leaking from the top. Complaint filed with NHTSA website, ODI 10560709. Not happy about having to spend over $1000 to replace the tank...

Day 8, still waiting. I still have no clue if they'll honor the PZEV warranty. Good thing they gave me a free 2013 C250 loaner car. However, this waiting is getting old. BMW, Infiniti & Honda are starting to look real good. Still not sure why it's taken 8 days to reach a decision on THEIR warranty.
