Class Action Settlement for Burl Walnut Trim Fading!!!

I just received this postcard today in the mail:




Looks like we may be getting repairs/reimbursement fo trim replacement!!! Yay!!!

This judgement COULD provide relief. Just wanted to let you guys know in case you want to get involved in the lawsuit. Please pass this info around to other owners you know who don't post here as well.

So how do you file a claim?


Edit: I see were this is going. Now I have to pay an MB dealer to deny my goodwill claim, and hope this goes thru. Otherwise I am out of the diag fee.

I went to the dealer and was told to call MBUSA, so I did. I don't have a transcript of the call, but I have the email saying I DID call, and the pics I took of my trim. Hopefully that is enough...

Not sure I follow... Do you currently have faded trim, and are determining the process under the settlement? I would think if you presented the mail notice from MB, that the local dealer would honor it.

If you paid the dealer the diagnosis fee in the past, and decided not to get the repair, I would think you could recover that fee by filing a claim.

(I've not read the website yet, as the trim in my car has already been replaced and has not faded since.)

Basically, he's saying he'll have to be denied service before you can file. Meaning he'll have to pay a diag fee to get the claim officially denied. Then, of the lawsuit doesn't pan out, he's out the diag fee.

But yes, according to the lawsuit, if you pay the diag fee and are denied replacement, you can get your diag fee reimbursed, AND get your trim replaced for free.

Was yours replaced under warranty? If so, you are not eligible for the suite. If you paid to have it replaced, you will be reimbursed completely for the repairs(winning the lawsuit and with proof, obviously)

Ima think the settlement notice covers "All class members" who have faded trim... diagnosis and/or previous denial not needed. But I'm not a lawyer (thank God)

That is what I read. The trim will be replaced IF the settlement is won.

I've submitted my claim. I purchased new trim on eBay from someone who sold their car before they installed it. I sent them plenty of evidence of purchase, registration, and so on (including this thread: https://mbworld.org/forums/e-class-w...w-tinting.html), so we will see how that goes.

I will say, it is a little unsettling that we don't really know if this will be (possibly significantly) pro-rated based upon the age of the car. But getting something is better than getting nothing, unless it's the pocket change I've received over some other class action lawsuits, that literally wasn't even worth my time/effort to submit the claim.

The wood on my car isnt that bad, but it has some splotchy spots and has faded a little. I dont feel like spending the money on it at this point so i will just see if they are successful. I know new wood would make the interior look perfect.

I've kept my old trim, thinking that I might try wrapping it. Mine had turned into swirled baby poop finish on the front pieces.

Well, after reading, it apparently will only cover 30% for older model years, if they settle or plaintiff gets the judgement, for mine it appears it's 50%

Because I’m working and just glanced over the site, lol, what did you read it will only cover 30% of the cars? Do you need a diagnosis, or just make sure you’ve filed with the law firm?

Yes, settlement is based on years, different for '10 vs. '16, if it's more than four years you get a percentage, for my '12 and '13 it's 50%, so get it repaired at the dealer, 1500 dollar bill, you get 750. {guessing on replacement cost} and likely for us pre-facelifts the wood on the lower door panels won't be covered as they don't see much sun, at least in my cars they all look new and retain the original red. too bad I like the faded color better in my black interior! I actually though about using a UV light to fade those to match.

And yes it says you needed to be denied for the repair/replacement in the past, but I never got paperwork on that, I just asked the SA and he said not covered, so no actual documentation, I am unaware if that excludes us or not.
Also it covers all the 212's just at different percentages of reimbursement.

I just registered both my cars without issue, other than I had to use my wife's name for the second car as only the VIN was different and it said I already registered.

I have no issue with my burl walnut, and it appears the extended warranty is automatic without having to register. I did get the postcard and it has the unique ID, which obviously is different than the one @nota_amg shows. Perhaps you should edit your post to mask that from prying eyes.

Got mine notice today, as well. I googled 'burl wood trim lawsuit' and there are a lot of pixs out there showing the damage. Mine' faded... wonder what this job costs. Looks like a ton of labor.
